Kinhtedothi - On February 12, speaking at a group discussion session, Prime Minister Pham Minh Chinh said that this amendment to the Law on Promulgation of Legal Documents aims to solve practical problems and simplify procedures.
Must resolve conflicts to continue development
According to Prime Minister Pham Minh Chinh, in the process of development, new conflicts will arise, and these conflicts must be resolved in order to continue development.
At the same time, the whole country is carrying out a revolution to streamline the apparatus effectively and efficiently, improving the quality of civil servants and public employees. According to the Prime Minister, this is a major policy of the Party, in February we will try to complete all organizations so that we can start operating in March. When we first start operating, there may be advantages as well as problems and difficulties, so we will continue to adjust.
A notable change of the Law on Promulgation of Legal Documents (amended) is to more clearly define the policy process and the drafting process. In which, the submitting agency decides on the policy, drafts and submits the draft to the National Assembly for decision, in order to create flexibility and maximize the rights of the submitting agency, especially the Government, so that the Government can be flexible, proactive in managing and responding to practical situations.
According to the Prime Minister, such innovation and demarcation is to clarify responsibilities, but there must still be close and effective coordination between the submitting agency and the reviewing agency as at present. The draft Law adding regulations on the Government's authority to issue legal resolutions is very necessary because in practice there are many urgent, important, and specific issues that the Government must issue resolutions to handle.
Citing the fact that the Government must issue regulations to respond to epidemics and natural disasters, Prime Minister Pham Minh Chinh said that a few years before the Covid-19 pandemic, the Government had to issue a resolution to implement it; similar to the recent storm No. 3, with such storms and floods, whether to destroy dams or not, whether to evacuate people or not, someone had to decide. This must be clear, meeting practical needs, and the issue of fluctuations, and the executive branch needs to be empowered.
"Our country is now deeply integrated, there are many things that we have to deal with that the law has not yet predicted. Therefore, the law needs to stipulate a principled framework, leaving room for the executive branch to flexibly implement effectively, as long as there is no embezzlement, corruption, or vested interests. At the same time, it should create space for creativity and protect creators, accept risks, as Resolution No. 57-NQ/TW recently said, accepting risks, not prosecuting people who do not have a motive for profit" - said the Prime Minister.
In addition, the Prime Minister proposed that the draft Law stipulate in the direction that the National Assembly Standing Committee must be the agency submitting reports on the examination of legal documents to the National Assembly instead of representing a Committee of the National Assembly as it is now.
"A mechanism for consulting experts and scientists is also very necessary. I myself often ask experts, so it should be added to the draft Law" - Prime Minister Pham Minh Chinh proposed.
Further strengthening the oversight function of the National Assembly
Speaking at the discussion session of group 19, including the National Assembly delegations of Thai Binh, Nam Dinh, and Binh Duong provinces, Vice Chairman of the National Assembly Nguyen Khac Dinh emphasized the need to comprehensively amend the Law on Promulgation of Legal Documents. Accordingly, the amendment of the Law is to promptly institutionalize Conclusion No. 119-KL/TW dated January 20, 2025 of the Politburo on the orientation of innovation and improvement of the law-making process; closely following the Project on innovation of the law-making process to ensure "professionalism, science, timeliness, feasibility, and efficiency".
According to Vice Chairman of the National Assembly Nguyen Khac Dinh, the review process has been conducted in parallel with the process of drafting the Law right from the stage of formulating ideas and outlines... Coordination has been carried out regularly and closely to ensure that the draft Law on Promulgation of Legal Documents (amended) is of the highest quality and submitted to the National Assembly; ensuring the goal of accelerating progress and improving the quality of drafting and promulgating legal documents to meet the requirements of the new period.
Along with that, closely following the requirement of innovation in thinking in law-making, building concise laws, only regulating framework issues, issues of principle, under the authority of the National Assembly, and frequently changing practical issues assigned to the Government and regulatory agencies to ensure flexibility in leadership and administration.
Regarding some specific contents in the draft, Vice Chairman of the National Assembly Nguyen Khac Dinh said that it is necessary to focus on the assessment of policy impacts, ensuring substance and avoiding formality. This draft Law does not stipulate the order and procedures for developing and promulgating legal documents of the Government. At the same time, reviewing to ensure that the provisions in the draft must clearly demonstrate the responsibilities of the subjects in implementing the procedures.
In addition, Vice Chairman of the National Assembly Nguyen Khac Dinh also noted the regulations related to the deadline for submitting appraisal documents, the issue of postponing the submission time as well as regulations on policy consultation. At the same time, he suggested paying attention to promoting and further strengthening the supervisory function of the National Assembly, especially the supervision of legal documents; there is a close and intimate relationship between the work of law making and the work of supervision, complementing each other.
Meanwhile, speaking at the discussion in the group, Deputy Prime Minister Le Thanh Long (National Assembly Delegate of Kien Giang Delegation) said that the process of drafting legal documents will be shortened in time, and at the same time, with the professional capacity and responsibility of relevant entities, it can still be implemented, ensuring the quality of laws and ordinances.
"Shortening the time for law making is an extremely important issue, ensuring the flexibility of executive agencies, law enforcement agencies and even the National Assembly in considering issues within their authority, responding better and faster to the requirements for national development" - Deputy Prime Minister Le Thanh Long emphasized.
