When dealing with obstacles for renewable energy projects, the Prime Minister especially noted that lobbying, negativity, corruption, and then having to deal with them, would result in loss of people, money, time, trust, and opportunities.
Do not create new violations
On the afternoon of December 12, concluding the online conference to announce and implement the Government's Resolution on policies and directions to remove obstacles and difficulties for renewable energy projects, Prime Minister Pham Minh Chinh said that the Government has put forward a number of general viewpoints and principles to resolve obstacles for projects, not to waste social resources, and not to reduce the confidence of domestic and foreign investors.
Specific projects will be assigned to localities to proactively work with businesses to resolve. If the problem is beyond their authority, it will be reported to the competent authority.
"The violations need to be separated and specific responsibilities must be assigned to the individuals involved. Violations must not be legalized, but solutions, mechanisms, and policies must be found to resolve them," the Prime Minister emphasized.
The Prime Minister stated that the immediate removal of obstacles to deploy and put renewable energy projects into operation is an objective and urgent requirement. If these projects are not removed to put them into operation, it will cause waste of invested capital; waste of electricity, and failure to supplement electricity when we are in dire need.
Therefore, removing difficulties and obstacles for these projects will be an important basis for increasing power sources to serve the socio-economic development goals in 2025 and the coming time.
According to the Prime Minister, the solutions to remove the problem have been highly agreed upon by ministries, branches and local agencies, and have been approved by the Government, so they need to be thoroughly implemented immediately, urgently, synchronously and effectively.
"The Government's message is to resolutely handle and resolve difficulties and obstacles, quickly deploy and maximize the efficiency of investment projects, contributing to promoting socio-economic development, in which GDP growth in 2025 will reach at least 8%," the head of the Government stated.
In terms of viewpoint, the Government determines to resolve difficulties with the spirit of choosing the optimal solution based on analysis, evaluation, comparison of socio-economic benefits and minimizing disputes, complaints, and impacts on the investment environment; ensuring security and order, national energy security and harmonizing the interests of the State, investors, businesses and people.
The Prime Minister noted that criminal proceedings are the last resort to facilitate the removal of obstacles for projects through economic solutions; if the current law changes, does not cause consequences, and there is no corruption, then no criminal proceedings will be taken.
Removing difficulties and obstacles for projects is considered legal when approved by competent authorities. Protecting the rights and legitimate interests of bona fide third parties according to the law.
"Do not create new violations, do not allow harassment, negativity and bad consequences in the handling process, especially mistakes on top of mistakes," the head of the Government directed.
Violations due to the fault of the enterprise are not entitled to FIT price.
Regarding the solution, the Prime Minister agreed to handle and allow additional planning for implementation in case the project does not violate regulations related to national security and defense, planning of key national works and projects.
For projects with violations of procedures and processes related to land and construction, they are allowed to be completed according to the provisions of law.
For projects that violate planning on minerals, irrigation, national defense, etc., an assessment of the socio-economic efficiency between planning and project implementation must be conducted to adjust overlapping planning accordingly; or integrate and simultaneously implement both renewable energy projects and related planning.
For projects that are enjoying preferential support prices (FIT) that violate the conclusion of competent authorities due to the fault of the enterprise and do not fully meet the conditions for enjoying FIT prices, they will not enjoy preferential FIT prices but must re-determine the electricity purchase and sale prices according to regulations; recover the preferential FIT prices that have been enjoyed incorrectly through offset payment for electricity purchases.
The Prime Minister stated that the authority of each level must resolve the issue publicly and transparently according to the solutions proposed by the Government; trying to resolve it completely before January 31, 2025.
The head of the Government requested that ministries, branches and localities thoroughly grasp the sense of responsibility, remove difficulties and immediately handle obstacles within their authority for projects on the principle that obstacles at which level must be handled and resolved, and must not be pushed to higher levels or handled in a roundabout way.
For projects that have been prosecuted, violations will only be handled and remedied after a verdict has come into effect according to the provisions of law. Handling of problems must be public and transparent; handling of problems for the purpose of corruption and group interests is strictly prohibited.
The Prime Minister pointed out that the removal of difficulties and obstacles for renewable energy projects must be public and transparent, without causing difficulties, inconveniences, or harassment. The Government has issued a policy to remove difficulties, localities must work with businesses to remove difficulties and obstacles, no one has to lobby for anything.
"It is especially forbidden to lobby, be negative, be corrupt and then have to deal with it, losing people, losing money, losing time, losing trust, losing opportunities. If anyone lobby, the authorities will handle it strictly," the Prime Minister emphasized.
By the end of 2023, the total capacity of renewable energy sources (wind power, solar power) in the power system will be 21,664 MW, accounting for about 27%; the cumulative annual electricity output of power sources (wind, ground-mounted solar, rooftop solar) will be about 27,317 million kWh, accounting for nearly 13% of the power system.
These results contribute to implementing the orientation in the Power Plan VIII, Vietnam's commitment at the COP26 Conference to achieve "zero" net emissions by 2050 and ensure energy security.
However, the implementation of the renewable energy development policy is a new solution, without precedent, lacking experience, and the legal system is not yet complete, so the implementation process still has some violations that have been specifically concluded by the Government Inspectorate.
At the regular Government meeting in November on December 7, 2024, the Government gave opinions and approved a Resolution on policies and directions to remove obstacles and difficulties for renewable energy projects.
