Vice Chairman of Bach Ninh Nhat Ward People's Committee said: In 2023, Ngoc Trao Ward is one of the units that successfully completed the task of granting land use right certificates (LURC) to households and individuals in the area, reaching 100% of the assigned plan. To complete the assigned targets, the Ward People's Committee has focused on directing the enhancement of the role and responsibility of leaders in State management of land; strengthening coordination between specialized departments and offices of the Town People's Committee and the Ward People's Committee in the field of land; promoting propaganda and dissemination of land policies and laws to every citizen in the area; strictly handling violations of land laws to ensure deterrence, education and prevention.
In the coming time, the Ward People's Committee requests the Department of Natural Resources and Environment of the town to guide the People's Committees of wards and communes on the auction process of public land use rights of 5% and exceeding 5% managed by the Ward People's Committee to ensure the legitimate rights and interests of land lessees and the State; requests the Branch of the Town Land Registration Office and the Department of Natural Resources and Environment to closely coordinate with the People's Committees of communes and wards to consider and promptly resolve the recommendations of households and individuals in the work of granting, re-granting certificates of land use rights, house ownership rights and other assets attached to land according to regulations.
According to the review report by the end of March 2024 of Bim Son town, the total number of agricultural land use right certificates that need to be issued for the first time is 3,273 certificates, 3,273 certificates have been issued to households and individuals (100% of the number of certificates needed); the number of forestry land use right certificates that need to be issued is 1,018 certificates, the number of certificates issued to households and individuals is 1,018 certificates (100% of the number of certificates needed). For residential land use right certificates that need to be issued is 13,599 certificates, the number of certificates issued to households and individuals is 13,553 certificates (99.66% of the number of certificates needed); Of which, 1,176/1,176 land use certificates have been granted in rural areas, reaching 100% of the number of land use certificates required; 12,370/12,416 land use certificates have been granted in urban areas, reaching 99.63% of the number of land use certificates required.
Regarding residential land, currently, many households and individuals have not requested to be granted a Certificate of Land Use Rights, or are in cases where the land user has passed away and now must divide the inheritance but the co-heirs have not agreed; the land area has increased significantly compared to the land use rights documents and must fulfill financial obligations when recognizing the land use rights but the households do not agree; the land is not suitable for the land use planning; the land is still in dispute; the land user household works far away and is unstable so there is not enough information about the land user; the land has been transferred many times but there are no more sale documents; the land is illegally built on vacant land; the land is lent by the People's Committees of communes and wards; the land is allocated without authority but the receipt does not state the content of land use fees... This is causing obstacles to land management in localities, easily giving rise to disputes related to land, affecting the legitimate rights and interests of the people.
To continue to strengthen land management, land registration and speed up the progress of granting land use right certificates in the area, the People's Committee of Bim Son town has issued Plan No. 3860/KH-UBND dated November 16, 2023 on implementing land registration, granting land use right certificates for the first time, granting land use right certificates after land consolidation and plot exchange in the town and issuing documents guiding the improvement of responsibility in confirming the origin of land use to serve the granting of land use right certificates to people; on guiding the process of re-determining the origin of land use right certificates for cases of revocation and re-issuance of land use right certificates originating from Ha Trung Farm land...; at the same time, perfecting the steering committee for granting land use right certificates and assigning the Vice Chairman of the People's Committee of the town to be the head of the committee; Establish a working group to assist the steering committee, headed by the Vice Chairman of the Town People's Committee, with members ranging from heads of specialized departments and offices to the Chairman of the People's Committee and land officials of communes and wards, with the aim of guiding and supporting people in the process of granting land use right certificates and carrying out related administrative procedures on land registration.
In addition, the town also concretizes administrative procedures and legal regulations on granting land use right certificates, land allocation, land lease, and land use purpose conversion into specific, simple, and easy-to-understand procedures. The model will be deployed, informed, and posted in all communes, wards, and neighborhoods to support people to access, grasp, and implement land procedures conveniently, easily, quickly, and effectively; strengthen the synchronous coordination between the town and the Town Land Registration Office Branch. The People's Committees of communes and wards are responsible for notifying and receiving applications for land use right certificates from people to determine the origin and time of land use, determine the legality of the land, and compliance with the planning... register land to prepare documents and submit them to the Town People's Committee to grant land use right certificates to eligible cases.
