Amending regulations on procedures for announcing operations of inland ports and wharves

The Government issued Decree 06/2024/ND-CP amending and supplementing a number of articles of Decree No. 08/2021/ND-CP dated January 28, 2021 of the Government regulating the management of inland waterway activities.

In which, amend and supplement Clause 4, Article 18 on the procedure for announcing the operation of inland ports and wharves.

Specifically, before putting a port or inland waterway terminal into operation, the owner of the port or inland waterway terminal shall submit directly or via the postal system or via the online public service portal or by other appropriate means a set of documents requesting the announcement of operation as prescribed:

For inland waterway ports receiving foreign watercraft: Submit documents to the Vietnam Inland Waterways Administration (for inland waterway ports on national inland waterways, specialized inland waterways connecting to national inland waterways, inland waterway ports with water areas, land areas both on national inland waterways and on local inland waterways, inland waterway ports in seaport waters connecting to national inland waterways), Department of Transport (for inland waterway ports on local inland waterways, specialized inland waterways connecting to local inland waterways, inland waterway ports in seaport waters connecting to local inland waterways in provinces and centrally-run cities) for appraisal.

Within 5 working days from the date of receipt of complete documents as prescribed, the Vietnam Inland Waterways Administration and the Department of Transport shall appraise the documents and, if qualified, report to the Ministry of Transport. Within 5 working days from the date of receipt of complete documents and appraisal report, the Ministry of Transport shall issue a decision to announce the operation of inland waterway ports.

For inland waterway ports that do not accept foreign watercraft: Submit the application to the Vietnam Inland Waterways Administration (for inland waterway ports subject to the provisions of Point b, Clause 2, Article 15 of this Decree) or the Department of Transport (for inland waterway ports subject to the provisions of Point c, Clause 2, Article 15 of this Decree). Within 5 working days from the date of receipt of the complete application as prescribed, the Vietnam Inland Waterways Administration or the Department of Transport shall issue a decision to announce the operation of the inland waterway port;

For inland waterway ports: Submit the application to the District People's Committee. Within 5 working days from the date of receiving the complete application as prescribed, the District People's Committee shall issue a decision to announce the operation of the inland waterway port; in case of submitting the application online, the application components shall be the original or electronic copies of the corresponding application components as prescribed.

In case of receiving the application directly, if the application is complete, a receipt will be issued and the results will be returned within the prescribed time limit. In case the application is not complete according to regulations, it will be returned immediately and the organization or individual will be instructed to complete the application. In case of receiving the application via the postal system or through the online public service system or by other appropriate means, if the application is not complete according to regulations, within 2 working days from the date of receiving the application, the agency receiving the application will send a written notice to the organization or individual via the postal system or through the online public service system or by other appropriate means, stating the reasons and requesting additional information and completion of the application.
