On March 25, the Conference of specialized National Assembly deputies gave opinions on the draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations.

The role of businesses and associations in developing international standards

Clarifying some contents, Minister of Science and Technology Nguyen Manh Hung said that the new approach related to this bill is to carry out comprehensive standardization.

According to Mr. Hung, this law has amended regulations to ensure compliance with international commitments, especially new generation FTAs; at the same time, it has added regulations to promote socialization in building standards, regulations, certification and inspection activities.

The bill also adds provisions to promote the role of enterprises and associations in developing standards and regulations; perfecting the processes for developing standards and regulations, especially regulations on impact assessment when developing national standards.

This revised law also pays special attention to the digital transformation of standards and regulations activities, such as building a national database on standards and regulations.

Enterprises must publish standards on the basis of electronic environment to increase publicity and transparency, creating conditions for people to actively participate in standards and regulations activities.

This amendment also assigns specialized ministries to take the initiative in regulating conformity declaration to create transparency for businesses.

More clearly regulate conformity assessment activities, unilaterally recognize assessment results, and conformity of foreign organizations to increase the openness of standards, as well as increase the conversion rate of international standards.

Accordingly, the international standard conversion rate from 62% will gradually increase to 70% and 80%.

Vice Chairman of the National Assembly said it is necessary to reduce requests and grants.

Concluding this content, reiterating the direction of General Secretary To Lam, Vice Chairman of the National Assembly Le Minh Hoan said that the law-making is not only for management but also to create space for development, while reducing asking and giving.

Regarding this bill, according to Mr. Hoan, it sounds technical but is related to economic issues. Because the regulations in the law will have a huge impact on industries and commerce, not just on a group of businesses but on the whole society.

He pointed out that a regulation on compliance with an animal feed product will be distributed to millions of livestock farmers across the country, because businesses must distribute all costs into the product price.

From there, Mr. Hoan suggested that the drafting agency research tools for the State to truly control without incurring too much cost for businesses and people.

A document certifying conformity but the signer is not responsible but only records the results, while the enterprise is still responsible for all those issues. We should review the spirit of post-audit, Mr. Hoan said.

He cited a few days ago news in the newspaper about the advertisement of Kera vegetable candy by Quang Linh Vlogs group, Hang Du Muc and Miss Thuy Tien as evidence of the self-control mechanism of industry associations.

When a consumer has doubts, they take the candy to the lab and find that it is not as advertised. So we give control to industry associations so that people have to control themselves, Mr. Hoan said.

He cited that in foreign countries, the stamping of industry associations is considered a guarantee of the quality of a business's products.

There are risks in any control mechanism, but we choose risks that have little impact on businesses, he added, through this to improve the capacity of businesses rather than just wanting to manage for safety in a simple way.

The draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations will be considered and approved by the National Assembly at its upcoming 9th session.
