Severely punish groups of violations that pose a danger to society
According to the report of the Ministry of Public Security (the drafting agency), the Decree on administrative sanctions for traffic order and safety in the field of road traffic; deduction of points, restoration of driving license points has the following scope of regulation: Administrative violations of traffic order and safety in the field of road traffic; forms, levels of sanctions, remedial measures for each violation; authority to draw up records, authority to impose sanctions, and fine levels.
Regulations on applying measures from driving license points; deduction levels for each behavior; order, procedures, authority to deduct points, and restore driving license points.
Other administrative violations in the field of state management related to traffic order and safety in the field of road traffic.
The draft Decree inherits and completes the existing stable regulations on administrative sanctions for road traffic order and safety; and adds new violations in the Law on Road Traffic Order and Safety.
During the development process, the Ministry of Public Security explained and accepted opinions in the assessment report on the compliance with the Penal Code to avoid administrativeizing criminal acts or omitting administrative violations; applying additional penalties; and temporarily seizing vehicles, documents of drivers and violating vehicles.
Colonel Pham Quang Huy, Deputy Director of the Traffic Police Department, said that one of the new points is that the draft Decree has increased the penalty level to ensure deterrence for groups of behaviors that are dangerous to society and are the cause of traffic accidents that have been analyzed and evaluated through practice such as: Failure to comply with traffic rules; violation of vehicle control regulations; related to road transport; affecting state management activities; causing public disorder, racing, etc.
Some opinions suggested studying regulations on publicizing the identities of those who violate traffic order and safety; increasing detection and punishment of groups of behaviors that are the main causes of traffic accidents such as handling violations of alcohol concentration in recent times; organizing propaganda and distributing leaflets to each household...
Deputy Minister of Education and Training Nguyen Thi Kim Chi said that schools need to integrate lectures, organize seminars, regularly propagate and disseminate to students to raise their sense of responsibility and the risks and harms if they do not comply with traffic safety; coordinate with authorities to instruct students on safe motorbike driving skills, "when students violate traffic order and safety, they need to send notices to the school and family".
The representative of the Ho Chi Minh City People's Committee proposed sanctions to handle subjects and vehicles participating in acts of encouraging swerving and racing; adding sanctions to confiscate trailers attached to motorbikes and mopeds.

From the reality of many tragic traffic accidents that occurred to pedestrians while crossing the street, Deputy Prime Minister Tran Hong Ha emphasized that the Decree must change the awareness and behavior of traffic participants, respect the law and the lives of others, "correct and strictly handle even the smallest violations".
The Decree also needs to stipulate the responsibilities and tasks of state agencies and local authorities in managing traffic infrastructure, organizing traffic activities (traffic lights, traffic diversion, signs), inspecting vehicles, etc. "The law stipulates that pedestrian crossings must have lines, signs, or traffic lights, but if there are none, which agency is responsible?", the Deputy Prime Minister raised the issue.
For smart vehicles, machinery, and new technology traffic equipment, there must be a separate and appropriate management mechanism. "If we don't know, we must have a way to manage it, not ban it."
Regarding the management of students using motorbikes and motorbikes in traffic, the Deputy Prime Minister requested regulations on teaching and guiding students about the law, traffic safety awareness, and motorbike driving skills, "with specific curriculum and locations", associated with the responsibilities of families, schools, and educational institutions.

Major General Nguyen Van Minh, Deputy Director of the Traffic Police Department, said that the draft Decree has added provisions on the responsibilities of families, schools, and educational institutions in managing students using motorbikes to participate in traffic. In particular, schools and families coordinate to remind and monitor students to comply with the law on road traffic order and safety; do not hand over vehicles to students who are not qualified and have not completed the program on safe motorbike driving skills; include compliance with the law on road traffic order and safety in the criteria for evaluating and classifying conduct. The Ministry of Education and Training includes students' compliance with the law on road traffic order and safety in the criteria for annual emulation evaluation of high schools.

The Ministry of Public Security also reviewed the contents of the regulations on the database on traffic order and safety to ensure completeness and synchronous connection with other functional agencies to serve the management and operation of traffic transport and traffic order and safety, making it convenient for people and businesses to look up and implement; promote the application of science and technology in traffic management and operation, towards reducing patrolling, controlling and handling violations directly by the traffic police force.

Regarding the Road Traffic Accident Damage Reduction Fund, the Ministries of Public Security, Finance, Justice, Transport and relevant agencies have agreed to draft a separate Decree to be submitted to the Government before June 30, 2025.
