According to Prime Minister Pham Minh Chinh, what is clear, mature, proven to be correct in practice, effectively implemented, and agreed by the majority should be legalized.


On February 12, after the opening session of the 9th Extraordinary Session, the National Assembly discussed in groups the Draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly and the Draft Law on Promulgation of Legal Documents (amended).

Regarding the draft Law on Promulgation of Legal Documents (amended), speaking at the meeting, Prime Minister Pham Minh Chinh said that the implementation of the Law on Promulgation of Legal Documents helps to perfect the procedures for promulgating documents, promote coordination between agencies in building and perfecting institutions to solve practical problems.

However, in the process of development, new conflicts will arise that need to be resolved, so amending the Law on Promulgation of Legal Documents this time is normal.

In addition, the Prime Minister emphasized: We are carrying out a revolution to streamline the apparatus effectively and efficiently, improving the quality of civil servants and public employees. This is a major policy of the Party, in February we will try to complete all organizations so that we can start operating in March. When we first start operating, there may be problems and issues, so we will continue to adjust.

According to the Prime Minister, this law amendment aims to “play the right role and know the right things”, clearly distinguishing the executive and legislative agencies. The clearer it is, the easier it is to evaluate, to determine responsibilities, and to decentralize in the spirit of local decisions, local actions, and local responsibilities, reducing administrative procedures and costs for the people. “Another principle is that if there are problems in practice, the law must be amended,” said the Prime Minister.

According to the Prime Minister, the draft law's addition of regulations on the Government's authority in issuing legal resolutions is necessary because in practice there are many urgent, important, and specific issues that the Government must issue resolutions to handle.

The Prime Minister also said that in the past, the Government's resolutions had the value of legal documents, but later the law stipulated that the Government's resolutions did not have legal status, instead, decrees were issued according to shortened procedures. However, in reality, when there are specific, special issues that need to be handled immediately, the Government can meet for 1 hour, right at night to decide, but no one dares to issue documents without legal status, as during the Covid-19 pandemic prevention period.

Meanwhile, decrees, even if issued in accordance with simplified procedures, still take a long time. In practice, when specific and urgent issues arise in a short period of time, we must resolve and handle them immediately, so it is necessary to stipulate that Government resolutions have legal value.

Citing the fact that the Government had to issue regulations to respond to epidemics and natural disasters, the Prime Minister said: “The recent Typhoon Yagi, with such heavy rain and floods, whether to destroy dams or not, to evacuate people or not, because evacuating means (evacuating) tens of thousands of people at night. Someone must decide. This must be clear, meeting practical needs, and the issue of fluctuations needs to be delegated to the executive branch.”

According to the Prime Minister, our country has deeply integrated, there are many things that the law has not yet predicted. Therefore, the law needs to provide a framework, in principle, to give room for the executive branch to flexibly implement effectively, as long as there is no embezzlement, corruption, or vested interests. At the same time, it is necessary to create space for creativity and protect creators and risk takers.

The Prime Minister stated that what is clear, mature, proven to be correct in practice, effectively implemented, and agreed by the majority of opinions should be legalized and continued to be implemented. What is still volatile, especially economic issues, should be delegated to the executive branch, on that basis, it can be handled flexibly and promptly.
