New Decree amends and supplements regulations on joint training at university, master's and doctoral levels

Decree No. 124/2024/ND-CP amends and supplements regulations on educational and training cooperation with foreign countries; amends and supplements regulations on training cooperation at university, master's and doctoral levels.

The Government has just issued Decree No. 124/2024/ND-CP amending and supplementing a number of articles of Decree No. 86/2018/ND-CP dated June 6, 2018 of the Government regulating foreign cooperation and investment in the field of education.

Amendment and supplementation of subjects implementing educational linkage

Decree amending and supplementing Article 6 on educational association subjects. Specifically, on the Vietnamese side: Private preschool education institutions and private general education institutions invested in by domestic investors and guaranteed operating conditions, established and operating in Vietnam.

Foreign party: Educational institutions established and operating legally abroad, operating for at least 5 years abroad as of the date of application submission and not violating the laws of the host country during the period of operation, providing direct teaching, having a valid certificate of educational quality assessment or being recognized for educational quality by a competent foreign educational agency or organization.

The organization providing educational programs must be established and legally operating abroad, and have been providing preschool or general education programs for at least 5 years as of the date of application for educational cooperation.

Fully disclose educational programs, assessment results, and number of foreign teachers

In addition, Decree 124/2024/ND-CP amends and supplements Point b, Clause 1, Article 7 on education programs. Integrated education programs must ensure the objectives of Vietnam's education programs and meet the requirements of foreign education programs; not requiring learners to relearn the same knowledge content, ensuring stability until the end of the level and connectivity between levels for the benefit of students, ensuring voluntary participation and not overloading students.

Decree 124/2024/ND-CP requires affiliated parties to be responsible for fully, accurately and clearly disclosing to students, parents and on the website of the educational institution information on educational programs and assessment results, the number of foreign teachers, the number of foreign students, testing methods, assessment of learning outcomes, and other contents as prescribed by relevant laws; and to be responsible for the accuracy of this information.

Amending regulations on joint training at university, master's and doctoral levels

Decree 124/2024/ND-CP also amends and supplements regulations on joint training at university, master's and doctoral levels.

Subjects of joint training for university, master's and doctoral degrees include: higher education institutions established and operating legally in Vietnam; higher education institutions established and operating legally abroad that meet the provisions of Clause 3, Article 45 of the Law on Higher Education (amended and supplemented in 2018).

Regarding training programs, Decree 124/2024/ND-CP clearly states: foreign training programs implemented in Vietnam must ensure the following requirements: be a training program of a foreign university, be permitted by a competent authority of that country to train and grant degrees or have a valid quality accreditation certificate issued by a legal quality accreditation organization.

The program does not contain content that is detrimental to national defense, security, or public interests; does not propagate religion or distort history; and does not negatively affect Vietnamese culture, ethics, and customs.

The Decree takes effect from November 20, 2024.
