That is the content of Decree No. 139/2024/ND-CP regulating the procedures for intercepting, accompanying, and forcing aircraft violating Vietnam's airspace to land at airports and airfields, which has just been issued by the Government.
The Decree stipulates that aircraft violating Vietnam's airspace without permission from Vietnamese authorities will be intercepted by aircraft of the Vietnam People's Army, preventing them from violating Vietnam's airspace.
An aircraft violating a flight permit will be accompanied by an aircraft of the Vietnam People's Army in a position suitable for the violating aircraft to guide and guide the flight until the violation ends. A violation of a flight permit is when an aircraft is licensed to fly in Vietnam's airspace but violates the contents of the flight permit (no-fly zone, restricted flight zone, flight rules, flying with incorrect data on time, altitude, and area recorded in the flight permit).
In terms of method, the intercepting and accompanying aircraft approach the violating aircraft from the left or right rear, depending on the maneuvering and observation conditions. Then, establish a suitable speed and distance to ensure safety, issue signs, signals and actions; at the same time, ensure that the pilot of the violating aircraft can receive signs, signals and actions from the intercepting and accompanying aircraft.
After the violating aircraft receives the information and stops the violation, the intercepting and accompanying aircraft will leave the area.
Aircraft are forced to land at airports if they fall into one of the following cases: being illegally interfered with while flying in Vietnam's airspace; aircraft violating Vietnam's airspace are intercepted or accompanied but do not comply with the actions of the Vietnam People's Army aircraft that are intercepting or accompanying.
In this case, the military aircraft approaches the violating aircraft from the left or right rear, depending on the maneuvering and observation conditions. When an aircraft violates the command of an intercepting, accompanying, or forced landing aircraft, and poses a risk of endangering an important target or affecting national defense and security, the handling shall be carried out in accordance with the regulations on handling air defense combat situations of the Ministry of National Defense.
The Minister of National Defense has the authority to order interception flights, escort flights, and forced landing flights.
The forces performing interception, escort, and forcing flights to land violating aircraft are aircraft and forces on combat duty of units under the Ministry of National Defense and the coordination of the forces managing civil aviation flight operations.
The Decree stipulates that the authority to order interception, escort, or force aircraft to land in violation of Vietnam's airspace is the Minister of National Defense.
For special aircraft violating Vietnam's airspace, the Minister of National Defense reports directly to the Prime Minister to decide on interception, escort, or forced landing.
