Draft Resolution of the National Assembly on piloting a number of mechanisms and policies to remove difficulties and obstacles in investment in construction of traffic works; A number of new policies in the field of management of entry, exit, transit and residence of foreigners in Vietnam; Draft Law on Citizen Identification (amended); Draft Law on Credit Institutions (amended); Proposal to develop a Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Exit, Entry, Transit and Residence of Foreigners in Vietnam.

Regarding the draft "Resolution of the National Assembly on piloting a number of mechanisms and policies to remove difficulties and obstacles in investment and construction of transport works", Government members discussed and contributed opinions on increasing the proportion of State budget capital participating in investment projects in the form of public-private partnership (PPP) or separating the site clearance part from public-private partnership projects; mobilizing local budgets to participate in national projects with central budget support; assigning localities to manage investment in regional linkage projects...

Regarding “Some new policies in the field of entry, exit, transit and residence management of foreigners in Vietnam”, Government members discussed the contents of expanding and granting electronic visas to citizens of all countries and territories in the world; increasing the duration of electronic visas (E-visas) from no more than 30 days to no more than 3 months, valid for one or multiple entries; increasing the duration of granting temporary residence certificates at border gates for people entering under unilateral visa exemption from 15 days to 45 days. The Government believes that the above adjustment aims to create favorable conditions for foreigners (tourists, investors, businessmen, etc.) in entering, exiting, transiting, residing and doing business in Vietnam.

Regarding the Draft Law on Citizen Identification (amended), the Government considered the conditions and requirements for drafting the Law; procedures and order of drafting the Law; the consistency of the legal system and compatibility with relevant international treaties. In particular, Government members discussed in depth new contents such as the issuance of identification cards to children under 14 years old, to people of Vietnamese origin abroad, and the integration of information on the database, etc.

The Prime Minister said that this is an important draft law, greatly affecting the rights and interests of the people; the content has many new issues, so there are still many different opinions that need to be carefully reviewed and evaluated.

The Prime Minister requested that the completion of the Law project must comply with and be consistent with the Party's policies, the Government's Resolution approving the Proposal for Law development, and the provisions of the Law on Promulgation of Legal Documents; not be perfectionist or hasty; organize consultations with affected subjects, experts, scientists, and practical activists; strengthen policy communication to create consensus; actively coordinate with relevant ministries, branches, and agencies, especially agencies of the National Assembly, to submit the draft Law to the National Assembly for comments at the 5th Session.

Regarding the Draft Law on Credit Institutions (amended), along with reviewing the order, procedures for submission, principles, requirements for law making, consistency and consistency with current legal regulations and draft laws being submitted by the Government to the National Assembly..., Government members have many opinions on issues such as payment priority, authority in special lending, independent auditing, seizure of collateral, the issue of "cross-ownership", inspection and supervision of credit institutions...

Along with giving opinions on each content, the Prime Minister said that this is a draft Law with many difficult, complicated, and sensitive contents, with great impacts on the whole society and the economy, and it is very necessary to amend and supplement to perfect it to meet the requirements of the new situation, especially to ensure the safety of the banking system, market transparency, and mobilize resources for socio-economic development.

The Prime Minister requested that the Law on Credit Institutions (amended) must ensure the concretization of the Resolutions and policies of the Party and the State; not be biased towards any subject; remove difficulties and obstacles; fight against corruption and cross-ownership; strengthen the management authority of the Governor of the State Bank over commercial banks, as well as in handling bad debts...; at the same time, request the State Bank to preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to study, receive opinions, revise and complete the draft Law dossier; report to the Prime Minister before submitting to the National Assembly for consideration and comments on the draft Law at the 5th Session.

Regarding the proposal to develop a Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Exit, Entry, Transit and Residence of Foreigners in Vietnam, Government members discussed continuing to reform administrative procedures in the field of exit and entry in the electronic environment; creating conditions for Vietnamese citizens to apply for visas to enter foreign countries, issuing ordinary passports according to simplified procedures; improving the effectiveness of state management, synchronization and uniformity of the legal system; creating further conditions for foreigners to enter and exit Vietnam; improving the effectiveness of foreign residence management in Vietnam, contributing to ensuring security, social order and safety, and socio-economic development.

The Prime Minister emphasized that the amendment and supplementation of the Law is very necessary to meet practical requirements in simplifying administrative procedures and facilitating entry and exit procedures for Vietnamese citizens and foreigners; assigning the Ministry of Public Security to preside over and coordinate with ministries and agencies to study and collect opinions, complete the dossier to submit to the National Assembly to add the proposal to build this Law to the Law and Ordinance Building Program in 2023.

Concluding the meeting, the Prime Minister said that over the past time, the Government has focused on implementing the Party's policies and the State's laws, including implementing 3 strategic breakthroughs, especially institutional breakthroughs. In the first 3 months of 2023, the Government held 3 thematic meetings on law-making, giving opinions on 16 projects and draft legal documents.

Prime Minister Pham Minh Chinh acknowledged and highly appreciated the ministries and branches for actively preparing and submitting projects and proposals for law making; seriously accepting and explaining thoroughly and with basis; ensuring progress and quality; actively appraising and examining the progress of submission to the Government; highly appreciating the dedicated, responsible, in-depth opinions with a high constructive spirit of the Government members and delegates.

The Head of Government assigned ministries and presiding agencies to seriously and fully absorb the opinions of Government members; continue to absorb and collect opinions from experts, affected subjects, and agencies of the National Assembly; complete draft laws, propose law making, and draft policies according to regulations; complete and submit documents to competent authorities according to procedures, ensuring progress and quality.

“What is ripe, clear, tested in practice, and stable should be legalized; what is uncertain and not tested in practice should be researched, tested, learned from, and gradually expanded; do not be perfectionist or hasty. Law-making must create a legal corridor, remove bottlenecks to serve development; promote decentralization and delegation of power, coupled with inspection and supervision,” the Prime Minister pointed out.

The Prime Minister also assigned news agencies and newspapers to strengthen policy communication, both to reflect and solicit public opinions and to clearly explain policies, especially the rights and interests of the people, creating consensus in the development and implementation of legal policies.
