Delegate Pham Hung Thai - Standing Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Tay Ninh province participated in giving comments.

Regarding the draft Law on Organization of Local Government (amended), delegate Pham Hung Thai - Head of the National Assembly Delegation of Tay Ninh province proposed that the draft Law supplement regulations on the working relationship between: the People's Council with the Vietnam Fatherland Front Committee and local socio-political organizations; the People's Council with local judicial agencies; the People's Committee with local judicial agencies; the People's Council and the People's Committee.

At the same time, the delegate proposed to clearly define in Article 7 of the draft Law on the relationship between the People's Committee and the Vietnam Fatherland Front Committee... as a cooperative relationship to effectively implement the functions and tasks of each party according to the provisions of law.

In Article 50, regarding transitional regulations, delegate Pham Hung Thai said that the 2-year period for legal documents containing regulations on the tasks and powers of local authorities at all levels to be amended and supplemented to comply with the Law is too long, inappropriate, and untimely.

Delegates proposed that it is necessary to clearly stipulate that during the period of waiting for amendments and supplements, relevant regulations contrary to the provisions of the Law on Organization of Local Government shall be implemented according to the Law on Organization of Local Government and the amendment and supplementation period shall be within 24 months for consistency and uniformity.

Participating in giving comments on this draft Law, delegate Huynh Thanh Phuong was concerned that the draft Law reduced 1 chapter and 93 articles, but there was no report clearly assessing the impact of reducing so many articles of the Law on the effectiveness and efficiency of the Law.

In Article 19, delegate Phuong requested the Drafting Committee to review the contents to ensure they are within the authority of the District People's Council, specifically:

Point b, Clause 1, stipulating that the People's Council at the district level decides on policies and plans for socio-economic development... is not within its authority. It is proposed to amend it to the decision to issue policies because the People's Council at the district level does not issue policies; if the Law has this authority and power delegated to the People's Council at the district level, it is proposed to review all relevant legal provisions.

Point h, Clause 1, stipulates that the District People's Council decides on the payroll, the proposed amendment is to allocate the payroll within the total assigned payroll.

Point k, Clause 1, suggests reviewing whether the word "village" has been commonly used or not to use it consistently and easily, because the southern provinces do not use the word "village".

In Clause 14, Article 28 of the draft Law, delegate Phuong requested the Drafting Committee to consider adding the following point: c. The content of "Decision on consent to arrest, detain, hold, prosecute People's Council delegates, search the residence and workplace of People's Council delegates" ensures full functions and powers of the Standing Committee of the People's Council and is consistent with the provisions of Clause 9, Article 30 of the draft Law.

Regarding this draft Law, delegate Hoang Thi Thanh Thuy - Deputy Head of the National Assembly Delegation of Tay Ninh province commented: Clause 1, Article 6 stipulates that the People's Committee at the local government level is elected by the People's Council at the same level, but does not stipulate the mechanism for electing the People's Committee at the government level that does not organize the People's Council. It is recommended to review and clearly stipulate the mechanism for electing the People's Committee for localities that do not organize the People's Council.

In addition, the duties and powers of People's Councils at all levels are quite fully stipulated in the draft Law, but there are no new points, and it is not clear which level is allowed to promulgate and decide on what issues to ensure innovation.

Specifically, Article 22 stipulates the tasks and powers of the People's Council at the commune level to decide on socio-economic development measures, decide on the State budget estimate... but what form of document is the People's Council at the commune level to issue, because the Law on Promulgation of Legal Documents does not stipulate the form of legal documents of the People's Council at the commune level.

Comments on the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus, in Clause 3, Article 4 " When reorganizing the state apparatus where the number of deputies of the head of an agency is greater than the maximum number according to current regulations, no later than 5 years from the effective date of the decision on the reorganization of the apparatus by the competent authority, the number of deputies of the head of the agency must comply with the regulations", Delegate Thuy said that the regulation of 5 years is too long, not timely and not innovative.
