To implement the 2024 Land Law and the Government's Decrees detailing the implementation instructions in the city, the Hanoi People's Committee requests departments, branches, People's Committees of districts, towns and related units to be responsible for implementing strictly, within their authority and regulations.

The Department of Natural Resources and Environment has submitted to the Hanoi People's Committee a draft regulation on conditions for land division and consolidation, and the minimum area and size for each type of land. The city is seeking opinions on this issue.

Based on the provisions of the Law, the Hanoi Department of Natural Resources and Environment proposes that if the land division does not create a new path in the ward or town, the land plot must ensure an area of ​​not less than 50 square meters, a length of over 4 meters and a width adjacent to the traffic road of 4 meters or more.

For communes in the plains, the minimum area for plot division is 80m2, for communes in the midlands it is 100m2, and for communes in the mountainous areas it is at least 150m2.

In case of land division with the formation of a walkway, the required cross-sectional width of the walkway is from 3.5m for towns, 4m or more for plain areas and 5m or more for midlands and mountainous areas.

Also according to the draft, non-agricultural land applies to plots of land that are not allocated or leased by the State to carry out projects in wards and towns (for commercial and service land), new plots of land must have a width adjacent to traffic roads of 10m or more, with a minimum area of ​​400m2.

For other types of non-agricultural land, the plot must be over 20m wide and have a minimum area of ​​1,000m2.

In other communes, commercial service land must have an area of ​​not less than 800m2 and other non-agricultural land must have an area of ​​not less than 2,000m2.

Currently, land division in Hanoi is applied according to Decision No. 20/2017.

According to regulations, the land plot after division must have a minimum area of ​​30m2 for wards and towns and not less than 50% of the new residential land allocation limit (minimum) for the remaining areas.

The Hanoi Department of Natural Resources and Environment said that land division must be carried out to ensure sustainable urban development and improve the quality of people's lives.

Regulations on land subdivision must balance the land use needs of the people and the goal of developing a civilized and modern capital. This requires that land subdivision not only comply with criteria on area and technical infrastructure, but also carefully consider urban planning and living space.

According to a representative of the Department of Natural Resources and Environment, long-term land division needs to take into account sustainable development factors, avoid disrupting the general planning or causing imbalances in technical and social infrastructure; at the same time, maintain cultural and historical values.
