The Vinh Tre commercial center residential project in Chau Phu district, An Giang province, approved in 2003, revealed a series of violations. The provincial inspectorate recommended transferring some contents to the investigation agency for criminal handling.
On January 4, a source from Giao Thong Newspaper reported that An Giang Provincial Inspectorate has just announced the conclusion of the inspection on compliance with the law on public investment in the 2021-2025 period in Chau Phu district and the implementation of the Vinh Tre Commercial Center Residential Area project (Vinh Tre Residential Area).
In conclusion, besides the achievements, there are still many violations in the Vinh Tre Residential Area project pointed out.
This project was approved by An Giang province in early 2003, with a total investment of more than 19.7 billion VND. The investor is the Chau Phu District Construction Investment Project Management Board (DPM Board).
Through inspection, it was found that the Chau Phu District People's Committee's commitment to guarantee the Traffic Construction Company (the project's construction unit) to borrow more than 16.6 billion VND from the An Giang Provincial Development Investment Fund to construct the project was baseless.
During the project implementation process, the Project Management Board borrowed nearly 1.6 billion VND from the An Giang Provincial Development Investment Fund, which was not in accordance with its assigned duties and authority.
The Inspectorate also concluded that Chau Phu District People's Committee had agreed and assigned the Project Management Board to sign an investment cooperation contract with the enterprise implementing the project to share profits.
Thus, the district did not comply with the direction of the Provincial People's Committee and did not properly perform its prescribed duties and powers.
Chau Phu District People's Committee and the Project Management Board have not fully settled the investment cooperation contract, incorrectly determined the actual amount paid to the Traffic Construction Company by more than 1 billion VND and omitted the debt payable to another enterprise.
Regarding land recovery, compensation, and site clearance, all stages were not in accordance with land law regulations at the time of implementation, such as not establishing a compensation council, not issuing a decision to recover specific land area for each plot of land, and not deciding on compensation and support for each household.
Illegal land exchange agreements, using people's land to carry out projects but not carrying out land recovery procedures... affecting people's rights.
Chau Phu District People's Committee and Project Management Board were determined to have violated the adjustment of the 1/500 detailed planning and incorrectly determined the estimated volume.
Approval for the sale of commercial land when the technical infrastructure system is not complete and the transfer of land use rights of 54 plots without auction.
An Giang Department of Finance and other departments advised the Provincial People's Committee to sell 270 plots of land in violation of the law.
Chau Phu District People's Committee determined land prices incorrectly, auctioned land use rights when conditions were not met, violated auction procedures... leading to the transfer of 270 plots of land without auction to officials, civil servants, and public employees, and risked loss of state budget...
The inspector determined that the above violations had objective causes, but also subjective causes. The main responsibility belongs to the Chau Phu District People's Committee, the individual chairman and vice chairman of the district People's Committee, the district project management board of each period...
After proposing administrative and economic handling, the inspector decided to transfer the case file showing signs of criminal law violations to the investigation agency for handling.
