Therefore, many tourism services and accommodation facilities have been invested in and built more and more to serve tourists.

However, despite the regulations on land and planning, many investors inside and outside the province have illegally built homestays, houses, accommodation services, and food services on agricultural land. Illegal constructions continuously "spring up" in Kon Pring community tourism village (in Mang Den town), roads in the center of Mang Den town and the area of ​​37 households in Kon Tu Rang village...

According to the reporter's records, typically in Kon Pring village, many constructions were built illegally, showing signs of business activities on agricultural land. In addition, some constructions are under construction. Typically, there are 2 illegal constructions of hundreds of square meters of Doan Thi Van (residing in Mang Den town) and Truong Nu Tuong Vi (residing in Phuoc An town, Krong Pak district, Dak Lak).

Specifically, Ms. Doan Thi Van committed an administrative violation of land appropriation and use of agricultural land for other purposes not permitted by competent State agencies with an area of ​​over 117 square meters (this area is managed by the People's Committee of Mang Den town). In addition, Ms. Van also converted perennial land into non-agricultural land to build a wooden stilt house with wooden walls. For the two acts of land appropriation and conversion of perennial land into non-agricultural land, Ms. Van was fined a total of 16 million VND by the People's Committee of Kon Plong district.

Up to now, the investor of this illegal construction is still procrastinating, not dismantling and restoring the original state.

Similarly, Ms. Truong Nu Tuong Vi's household also converted perennial land to non-agricultural land to build items such as: brick house, wooden house, hexagonal house with an area of ​​over 422m2 (this land area is managed by Mang Den Town People's Committee).

In addition to the above illegal constructions, in Kon Pring village, there is also the household of Mr. Luong Van Dung (born in 1991, residing in residential group 3, Mang Den town) who committed administrative violations such as: Not converting the purpose of using perennial crop land to other non-agricultural land with an area of ​​175.2m², encroaching on 20m2.

This individual also built 4 wooden stilt houses without a building permit. For the above violation, Mr. Dung was fined a total of 50 million VND by the People's Committee of Kon Plong district.

A series of motels owned by Ms. Truong Nu Tuong Vi were illegally built on land used for perennial crops.

According to the People's Committee of Kon Plong district, the total number of violations in the field of land and construction occurring in the district from 2021 to present is still pending, not completely resolved 49 cases with a fine of more than 1 billion VND. Of which, Mang Canh commune has 23 cases and Mang Den town has 26 cases.

Investors defy regulations and delay dismantling illegal constructions

It is worth mentioning that while a series of illegally built works in previous years have not been completely resolved, in just the first 7 months of 2024, there were 15 more violations in Mang Den town.

Authorities dismantle illegal construction works in Kon Pring village

It is known that violations in the field of land and construction occurring in Kon Plong district have been sanctioned by the People's Committees of communes, towns and the district People's Committee. However, up to now, there are still many cases that have not complied with paying fines to the State budget; at the same time, measures to remedy the consequences have not been taken.

According to the reporter's investigation, all households that violated the regulations from 2021 to now have not yet restored their original status. Regarding this issue, the People's Committee of Kon Plong district has repeatedly issued documents urging and requesting the demolition of violating constructions, but the investors still deliberately ignored and did not comply.

Speaking to reporters, Mr. Le Thanh Dien - Head of the Department of Natural Resources and Environment of Kon Plong district said: "The unit has also issued many documents requesting the People's Committee of Mang Den town and the People's Committee of Mang Canh commune to regularly inspect land management and construction order in the area, and handle violations. At the same time, promptly detect and handle cases of construction of houses, homestays, accommodation services, food and beverage services... without permission from competent State agencies, and prepare records to handle violations according to regulations. In cases beyond authority, the records will be transferred to competent authorities for settlement."

According to Mr. Dien, for cases that have been administratively sanctioned but have not paid the fine to the State budget, the People's Committees of communes and towns will take steps according to regulations on enforcing decisions on administrative sanctions.

Although the government has continuously issued documents urging and requesting the demolition of illegal constructions, investors still ignore and delay implementation.

“Currently, most of the households that violated the law have paid the fines, but they have not yet remedied the consequences. First of all, the commune government must resolutely implement this, propagate and mobilize people to voluntarily dismantle the violations. If they still do not comply, they must take measures according to the law.

Because when a decision to handle a violation is issued according to the law, a decision to enforce it must be issued. Many violations have occurred for a long time, so you must have a roadmap for handling them. You must do it one case at a time, and finish each case so that people do not compare," Mr. Dien added.
