Will submit adjustment of 8 land use indicators
According to the provisions of the 2024 Land Law and Decree No. 102, the Government will submit to the National Assembly an adjustment to the National Land Use Plan with the main contents including adjusting eight land use indicators. Thereby, these indicators include agricultural land, including rice-growing land, special-use forest land, protective forest land, production forest land that is natural forest; non-agricultural land, including national defense and security land. The Government emphasized that the calculation and determination of eight land use indicators in the adjusted National Land Use Plan this time must be carefully reviewed and balanced with land use indicators of sectors, fields and localities. In which, priority should be given to allocating land funds for national defense and security purposes, stabilizing rice-growing land funds to ensure national food security, strictly managing forest land, maintaining forest cover to contribute to protecting the ecological environment, responding to climate change and achieving sustainable development goals. The Government proposed to include this content in the general resolution of the 8th session. The Government will then organize the preparation, appraisal, and submission to the National Assembly for consideration and approval of the detailed plan at the end of 2025. Reviewing this content, Chairman of the National Assembly's Economic Committee Vu Hong Thanh said that the Government's proposal to adjust the National Land Use Plan is consistent with the National Assembly's requirements, especially in the context that our country is preparing to implement a number of important national projects (the high-speed railway project on the North-South axis). However, this committee requested the Government to analyze, comprehensively evaluate, and clarify the reasons why many land use indicators are at very low levels, in which land for education, health care, culture, and sports only reaches 2 - 5.5%. On the same day, the National Assembly discussed the draft Law on Juvenile Justice in the hall. One of the newly revised issues is the regulation on the synthesis of penalties in cases where minors commit multiple crimes. Chairwoman of the Judicial Committee Le Thi Nga said that the National Assembly Standing Committee has directed a thorough review and found that the current Penal Code's regulation on the synthesis of penalties is unreasonable, leading to a lack of fairness, so it needs to be revised to overcome the unfairness. Regarding the total level of common penalties, the draft proposed to revise it in the direction of not exceeding 12 years in prison for people aged 14 to under 16 and not exceeding 18 years in prison for people aged 16 to under 18. The total level of penalties is applied uniformly to all crimes, not just to five crimes as in the previous draft: murder, rape, rape of people under 16, rape of people aged 13 to under 16, and illegal production of narcotics. According to Ms. Nga, this provision ensures differentiation in the handling policy between minors who commit one crime and minors who commit multiple crimes, while not increasing the responsibility for handling compared to the provisions of the Penal Code. At the same time, it overcomes the shortcomings in the provisions of the Penal Code on the synthesis of penalties and does not create new contradictions in the synthesis of penalties. In addition to the fixed-term imprisonment penalty, according to Ms. Nga, the draft law continues to inherit the provisions of the Penal Code on three other types of penalties (including warnings, fines, and non-custodial reform). This provision aims to ensure conformity with the nature and level of danger of each criminal act, while institutionalizing Resolution No. 49 of the Politburo on "reducing prison sentences, expanding the application of fines, non-custodial reform penalties...". Ms. Nga added that the National Assembly Standing Committee has directed a thorough review of the provisions of each type of penalty to both ensure deterrence and crime prevention while promoting humanity and benevolence in handling juvenile offenders.Proposal to bring national treasures to Vietnam using the Cultural Heritage Conservation Fund
On the same day, the National Assembly also discussed a number of contents with different opinions in the draft Law on Cultural Heritage (amended). Notably, regarding the Cultural Heritage Conservation Fund, the draft law stipulates a fund to support funding for a number of truly necessary and specific activities in cultural heritage conservation that the state budget cannot yet meet. Such as purchasing and bringing relics, antiques, national treasures, documentary heritage, rare documents on intangible cultural heritage of Vietnamese origin back to the country from abroad... The fund's financial resources are formed on the basis of aid, sponsorship, support, donations from domestic and foreign organizations and individuals and other legal financial sources. Currently, the state budget does not support. The National Assembly Standing Committee proposed to complete the direction that the fund only supports funding for a number of key and focal activities.
