Quang Nam Provincial People's Committee has recently requested a series of agencies, including: Department of Planning and Investment, Department of Finance, Department of Natural Resources and Environment, Department of Construction, Department of Industry and Trade, Provincial Tax Department, Dien Ban Town People's Committee and related agencies and units based on their assigned functions and tasks to take the lead and coordinate with related agencies and units to study the content of recommendations and proposals of Dien Ban Town Business Association on reflecting some difficulties and problems in the production and business process of enterprises.

According to the reflection of Dien Ban Town Business Association, previously, projects were allocated land in many stages according to the site clearance situation, but now, based on each stage of the project approved by competent authorities to allocate land, it is not suitable for projects in the transitional area.

According to the reflection of Dien Ban Town Business Association, previously, all housing construction investment projects were not divided into investment phases. Therefore, currently, projects must wait for the completion of 100% site clearance before land allocation and land lease. In fact, many projects must arrange for on-site resettlement, people must be arranged for resettlement before agreeing to land allocation. Implementing 100% site clearance in a period of time is impossible, not feasible...

Therefore, Dien Ban Town Business Association proposed that the Town People's Committee recommend the Provincial People's Committee to allow land allocation on a case-by-case basis as before, especially for unfinished projects, creating conditions for investors to continue to complete the project and hand it over for use.

Dien Ban Town Business Association reported that currently, the province is stopping the transfer and granting of Land Use Right Certificates to customers receiving the transfer of land plots that have been granted Land Use Right Certificates in a number of projects that have not completed 100% of the infrastructure and have not been handed over for use.

This directly affects the interests of customers, causing many complaints, lawsuits, and disputes of customers. "In the same project, even in the same block, 2 adjacent plots of land, but 1 plot has been transferred to the customer's name, they can be freely bought, sold, and transferred, while the remaining plot, the customer has fulfilled tax obligations, signed a transfer contract with the investor, but is prevented from transferring the Land Use Rights Certificate", the representative of Dien Ban Town Business Association reflected and proposed that the Town People's Committee report to the Provincial People's Committee to allow continued subdivision and transfer of blocks that have been granted Land Use Rights Certificates.

According to Dien Ban Town Business Association, currently, the province's policy is to grant block land use right certificates for infrastructure construction projects, but does not allow land division and transfer. Only when 100% of the infrastructure is completed according to the approved plan can land division and transfer be allowed.

“If the certificate is issued but cannot be transferred, what will the investor do with the certificate? The bank will not accept the mortgage because if the certificate cannot be transferred, the bank will not lend. Meanwhile, to be issued the certificate, the investor must pay land use fees to the budget, the capital is buried in the budget, in infrastructure investment but it is not known when the capital will be mobilized,” the representative of the Dien Ban Town Business Association wondered.

Therefore, Dien Ban Town Business Association proposed that Dien Ban Town People's Committee report to the Provincial People's Committee to allow the issuance of red books and land division and transfer for projects with basically completed infrastructure.

In addition, this unit also recommended that local authorities remove difficulties and obstacles in determining land prices, receiving and handing over technical infrastructure of projects, construction material prices, scarcity of earth filling materials, access to credit capital, etc.
