According to Mr. Tran Huu Linh, in order to effectively prevent and combat violations in e-commerce, in March 2023, the Government approved Project 319 on anti-counterfeiting and consumer protection in e-commerce until 2025.
The project has amended, supplemented and overcome legal gaps, contributing to improving the effectiveness of consumer protection in e-commerce activities, creating trust for consumers in online transactions and purchases; the legitimate rights and interests of businesses and consumers are guaranteed.
In addition, the Project also contributes to ensuring transparent and healthy e-commerce activities, effectively protecting the legitimate rights and interests of businesses and consumers; promoting sustainable e-commerce development in Vietnam.
The Director General of the General Department of Market Management said that the birth of Project 319 is necessary and urgent because counterfeit goods sold on the Internet is a new and hot front because 80%-90% of counterfeit goods are bought and sold online.

“Counterfeit goods displayed on the streets, in the streets, in the shops are easy to detect, but counterfeit goods sold online are extremely difficult to handle. The professionalism in detecting and handling counterfeit goods online is very high. Therefore, the process of controlling and handling... the Market Management force encounters many difficulties such as: the place of purchase and sale cannot be determined, the seller can be anywhere; the warehouse and time of contract signing are difficult to determine, and evidence can easily change.
Furthermore, payment through intermediaries makes the tracing process even more difficult. This has also created challenges for authorities in the work of inspecting and controlling the quality of goods," said Mr. Tran Huu Linh.
Meanwhile, violations of goods in the "online market" are very widespread, occurring in many product lines such as: fashion, cosmetics, household appliances, electronics; even weapons, support tools, recording devices, video recording, positioning, and jamming devices; drugs, stimulants...
Sharing this view, Mr. Nguyen Phuong Minh - representative of the Department of Intellectual Property (Ministry of Science and Technology) said that any branded, profitable, and reputable goods are counterfeited and infringed upon intellectual property rights. Counterfeit goods and intellectual property infringements are mainly small-scale manual production, or component assembly, and product packaging.
According to Mr. Tran Huu Linh, to prevent counterfeit goods on the "online market", the first responsibility belongs to the Market Management force but still requires close coordination between relevant ministries, sectors, businesses and consumers.

Representing a large e-commerce platform, Mr. Phan Manh Ha - representative of Shopee said that by the end of November 2023, Shopee received 0.0007% of complaints about counterfeit goods/goods infringing intellectual property rights on total orders; 74.8% of complaints were accepted and processed within 7 days; 0.1% of complaints were withdrawn by the complainant...
In the past, Shopee protected both buyers and sellers by holding the transaction amount between the buyer and seller until the order was completed. The transaction amount will only be paid to the seller if: The buyer is completely satisfied with the item and has no complaints within 7 days (for Mall Shops) or 3 days (for non-Mall Shops) from the date of receipt of the item, or the buyer has clicked “Received item” (for non-Shopee Mall Shops), or when the buyer has submitted a return/refund request and Shopee has processed it...
In addition to the above solutions, Shopee also implements a mechanism for reporting/reporting violations and handling complaints. Accordingly, consumers can use the reporting feature on the Shopee mobile application to send reports about counterfeit/counterfeit products or violations at any time. The censorship department will receive the information and have a handling mechanism if the content and evidence of the complaint are legitimate.

“In the coming time, we will coordinate with brands and countries to handle intellectual property violations, including assigning responsibility to the stalls on the platform. At the same time, Lazada will also guide the conditions for exchanging and returning goods, with a commitment to ensuring genuine goods and strictly handling stalls selling fake and poor quality goods,” Ms. Vu Thi Minh Tu informed.
Presenting his viewpoint on the direction to eliminate counterfeit goods on the "online market", Mr. Tran Huu Linh emphasized: "We will not discuss it anymore, no matter how difficult it is, we still have to do it. First, we need to tighten the licensing activities for the floors and stalls on the floors, thereby controlling the quality of goods to protect the rights of consumers, protect businesses as well as build a healthy e-commerce environment, promote economic development. The Market Management Force has determined that fighting counterfeit goods on e-commerce will be the key task of the force in the next 3 to 5 years".
