National Assembly delegate Pham Van Hoa said it was "extremely rude and disrespectful to customers" to suddenly be interrupted by an advertisement while watching a movie or other interesting content.


Advertising must also take into account the needs of readers.

This afternoon (November 25), participating in the discussion at the National Assembly hall about the draft Law amending and supplementing a number of articles of the Law on Advertising, National Assembly delegate Pham Van Hoa (Dong Thap delegation) contributed his opinion on advertising in print newspapers.

He pointed out that, currently, with the development of online advertising, the market share of advertising in print newspapers has decreased sharply. Adjusting advertising space in print newspapers has not fundamentally solved the difficulties of press agencies in practicing financial autonomy.

National Assembly Delegate Pham Van Hoa spoke at the discussion on the Law amending and supplementing a number of articles of the Law on Advertising.

"Therefore, it is recommended to study the option of removing the limit on advertising area ratio in traditional newspapers and magazines; to let press agencies decide for themselves according to the advertising needs of readers and the market," the delegate proposed.

Although proposing that "advertising is the responsibility of the press agency", delegate Hoa still believes that if readers see too much advertising, they may boycott the newspaper, causing it to not develop and have no revenue.

Regarding advertising in newspapers and television, delegates mentioned that recently, there have been cases where while watching movies or other content, when the interesting part is suddenly interrupted and an advertisement is displayed.

Considering this to be "extremely rude and disrespectful to customers", delegates suggested that it is necessary to regulate the appropriate time for advertising.

At the same time, delegate Hoa proposed that it is necessary to stipulate that the advertiser must be responsible for the advertising content and the products they advertise.

Because when the advertiser is very reputable like MC, famous artist, it will make people believe that the product is good. But in reality, the advertised product is of poor quality, it is no different from advertising for a fake, counterfeit, fake product, the advertiser only knows how to pocket the money.

In addition, delegates said that licensing advertising works needs to be coordinated with legal regulations on construction and road traffic safety.

"As the form of advertising by pasting printed flyers on electric poles is very popular nowadays, there should be clear and specific regulations. I think advertising on electric poles is also fine, and does not cause any problems if it is licensed," said the delegate.

It's not the lack of space, it's the lack of advertising.

Debate on advertising space in print newspapers, National Assembly member Do Chi Nghia (Phu Yen delegation) said that the opinions of the National Assembly members all expressed the view that expanding advertising space in print newspapers will help press agencies better implement the financial autonomy mechanism and better in their operations.

However, the reality is that the press agencies are facing difficulties not because of lack of advertising space but the most difficult thing is lack of advertising.

Businesses and advertisers have many other advertising methods that are more effective than print.

The market can fluctuate, so delegate Do Chi Nghia supports the method of giving press agencies autonomy over this advertising space.

However, delegate Nghia expressed concern that if this autonomy and self-determination of advertising space is given, it could lead to some press agencies with a stable number of readers, a stable circulation, or newspapers guaranteed by the state budget increasing advertising space, which would be very offensive. Newspapers and magazines are decided by the market, decided by readers.

"Newspapers and magazines should decide on advertising space in print, except for special press agencies, press agencies using the state budget, press agencies that place orders, newspapers that have their products covered...", Mr. Nghia proposed.

At the same time, the delegate said that the Government should be assigned to regulate in detail the specific press agencies and newspapers guaranteed by the state budget. The rest should be regulated openly for efficiency, suitable for the current market economy conditions when readers are very discerning, will choose products that are serious, decent and responsible to the public and to society.

Vietnam lost more than 1,000 billion VND from online advertising

National Assembly Deputy Thach Phuoc Binh (Tra Vinh delegation) expressed his hope that the amendments and supplements to the draft law this time would pay attention to regulations on management and handling of violations in advertising activities.

Delegates said that the draft Advertising Law 2012 mainly regulates traditional forms of advertising, and does not have specific regulations on online advertising. Currently, more than 70% of online advertising violations are handled slowly due to the lack of consistent regulations.

Therefore, delegates proposed adding a specific provision on online advertising to the draft law.

Accordingly, regulations will be developed to manage new forms of advertising, including advertising on social networks, advertising using artificial intelligence applications, etc.; and clear guidance will be provided on the responsibilities and obligations of advertising participants (advertisers, online platforms).

Establish an inter-sectoral coordination mechanism and cooperation between the Ministry of Culture, Sports and Tourism, the Ministry of Information and Communications and the Ministry of Public Security to handle violations more effectively.

According to the delegate, the advertising market share in Vietnam is currently mainly in the hands of cross-border platforms such as Facebook, Google, Tiktok... In 2023, these platforms will account for 75% of advertising revenue, while traditional newspapers will account for less than 10%.

Notably, these platforms often do not fully register their operations in Vietnam or only partially register, leading to ineffective tax management. In 2023, Vietnam lost more than VND1,000 billion from online advertising, putting pressure on the national budget revenue.

Concerned about controlling online advertising content, delegates suggested adding regulations requiring platforms to review and censor advertising content before displaying it.

Establish strong sanctions, requiring the removal of violating content within 24 hours. In particular, increase the administrative fine for false advertising to 2-3 times the benefit gained; publicize the list of violating businesses as a deterrent.

To protect consumer rights in online advertising, delegate Thach Phuoc Binh requested that advertisements must clearly state product and service information, responsible unit and after-sales support mechanism.

Enact strict sanctions against the unauthorized use of customer personal data; strengthen propaganda and raise public awareness of privacy and personal information protection.
