Will administrative violations of land decrease under the new law?
At the program, Mr. Do Van Ban - Party cell secretary of Ward 11, Long Thanh My Ward, Ho Chi Minh City - raised the question of whether the 2024 Land Law will reduce administrative violations related to land?
At the same time, he also worried about the recent draft of the land price list of the City People's Committee. "What has the City researched and implemented to build a new land price list close to the market price and what is the purpose of the new land price list and how will it affect the people?", Mr. Ban said.
In response to this question, Director of the Department of Natural Resources and Environment of Ho Chi Minh City Nguyen Toan Thang said that the 2024 Land Law will reduce administrative violations related to land. According to him, the new law has increased the number of prohibited acts (the 2024 Land Law stipulates 11 acts, while the 2013 Land Law stipulates 10 acts).
In addition, the amount of illegal profits from administrative violations in the land sector that must be paid to the state budget will increase, which is a very strong deterrent. Therefore, the number of violations will certainly be greatly affected.
Regarding the land price list, Mr. Thang said that the city is very cautious. Although the time for collecting public opinions ended on July 26, the city has also organized additional conferences to listen and receive feedback on this content.
The Department will fully accept it, then the City Land Price Appraisal Council will independently appraise it. When the appraisal council approves, the Department will accept, complete, and submit it to the Department of Justice for appraisal before submitting it to the City People's Committee to issue a decision.
According to regulations, the land price list is the basis for calculating financial obligations when carrying out procedures for 12 subjects. The adjusted land price list will affect the subjects when carrying out financial obligations such as paying land use fees, paying taxes, paying fees, and paying administrative fines.
Regarding the land price list, lawyer Nguyen Van Hau, vice chairman of the Ho Chi Minh City Bar Association, commented that since the news that the city was about to issue a new land price list, the number of people doing procedures related to changing land use purposes and granting land use right certificates has been very high.
However, in recent days, many applications for land use purpose change submitted by Ho Chi Minh City residents since August 1 (Land Law 2024 takes effect) are being "suspended". Tax offices of districts, towns and Thu Duc City are still accepting applications but cannot calculate land use fees to be paid.
He wondered when people would be able to get their applications processed if they submitted complete documents now? When is the expected time to complete the land use fee calculation and how will this affect the progress of land procedures?

The Director of the Department of Natural Resources and Environment of Ho Chi Minh City said that if the provincial People's Committee adjusts the land price list from August 1, the new price list must be applied when submitting documents to change land use purposes.
However, Ho Chi Minh City has not yet issued a new land price list and the City People's Committee has reported to the Prime Minister for guidance for the provinces and cities that are currently facing difficulties. However, this does not cause a backlog of documents, the agencies that are handling the documents must handle the documents.
Will the provisions of the 2024 Land Law increase social housing prices?
Also at the program, voter Thanh Le raised the issue of whether the 2024 Land Law will affect social housing projects and increase prices or not?
Deputy Director of the Ho Chi Minh City Department of Construction Huynh Thanh Khiet said that the 2024 Land Law has a number of contents that create more favorable and open conditions for investors and state management agencies during the implementation process.
He cited Article 33 which stipulates that in cases where the State allocates land to implement social housing projects, in cases where land use fees are exempted or reduced, the rights and obligations are the same as in cases where land use fees are not exempted or reduced.
Regarding social housing prices, according to Mr. Khiet, social housing is exempt from land use fees, but the most important thing is the cost structure to create that social housing.
As Decree No. 100/2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing, the social housing interest rate is 10%.
In social housing projects, investors have 20% for business and do not account for the remaining 80%. This is completely different from the old law.
On the other hand, the total investment cost of construction of social housing area includes the construction investment costs of the social housing construction investment project.
Thus, the structure of selling, renting, and leasing prices for social housing related to land includes compensation, support, and resettlement costs (if any), while compensation under the 2013 and 2024 Land Laws are both implemented according to market mechanisms, so there is not enough basis to determine whether the 2024 Land Law will increase social housing prices or not.
