One-stop mechanism at Ho Chi Minh City industrial parks facilitates business investment

The implementation of the “one-stop, on-site” mechanism in industrial parks in Ho Chi Minh City has helped simplify administrative procedures, supporting businesses to quickly invest in expanding production.

The Ho Chi Minh City Export Processing and Industrial Zones Authority (Hepza) has just reported to the Department of Planning and Investment on the results achieved after one year of implementing Resolution 98/2023/QH15 (Resolution 98).

According to Resolution 98, Hepza is authorized by the Ho Chi Minh City People's Committee to appraise, approve and adjust detailed construction planning projects at a scale of 1/500 within the Export Processing Zones (EPZs) and Industrial Parks (IPs); appraise and approve environmental impact assessment reports; issue, change, reissue, adjust and revoke environmental licenses within the EPZs and IPs.

Implementing the one-stop mechanism helps businesses avoid having to submit documents to many places.

After one year of implementing Resolution 98, Hepza has received 10 dossiers requesting adjustment of detailed planning of investment projects, of which 4 dossiers have been approved; one dossier has been returned without being processed because the Appraisal Council has failed to pass; one dossier is waiting for the consensus of the Department of Planning and Architecture; 4 dossiers are being edited by the investor after receiving the consensus of the Department of Planning and Architecture.

Hepza has handled 30 applications for environmental licenses (under provincial authority) and resolved 8 Environmental license application (under district authority):  

After one year of implementing decentralization, Hepza assessed that the implementation of the "one-stop, on-site" mechanism at the Industrial Park has contributed to reforming and simplifying administrative procedures, creating favorable conditions for business activities, so it is highly appreciated by investors.

This creates a favorable investment environment, supporting businesses to quickly put projects into operation and invest in expanding production.

Furthermore, the settlement of environmental legal procedures at a single point at Hepza will facilitate the inspection and supervision of enterprises in EPZs and industrial parks in implementing environmental protection laws.

For industrial parks located in 2 or more districts (such as Vinh Loc Industrial Park in Binh Chanh District, Binh Tan District and Hoc Mon District), decentralization to the Management Board to approve and adjust tasks and detailed construction planning projects 1/500 within the scope of the industrial park will facilitate project investors in carrying out administrative procedures because they only need to submit documents through one contact point.

Despite being decentralized, Hepza said there are still difficulties and problems, such as the procedure for appraising and approving 1/500 construction planning projects within the scope of export processing zones and industrial parks, the time to get opinions from the Department of Planning and Architecture is 15 days.

However, most of the files sent to the Department of Planning and Architecture for comments, the time for this Department to respond is from 30 to 45 days, leading to a temporary suspension of the file processing process on the City's administrative procedure processing information system.

On the other hand, the Law on Environmental Protection 2020 and Decree No. 08/2022/ND-CP detailing a number of articles of the Law on Environmental Protection still have many problems in the implementation process and many interpretations from different perspectives, so we have to wait for the written response and guidance from the Ministry of Natural Resources and Environment and the Department of Natural Resources and Environment to guide businesses.

For secondary projects located in export processing zones and industrial parks, having to consult with the community also takes a lot of time and money and affects the investment progress of enterprises.
