The Ministry of Industry and Trade is seeking comments on a draft Circular detailing a number of articles of the new Decree on petroleum trading. The draft of a new Decree on petroleum trading to replace the current Decrees on petroleum trading is also being sought from Government members by the Government Office.
According to the draft Circular, the constituent elements in the gasoline price formula are built based on current relevant legal regulations, the results of synthesizing data from key gasoline traders, gasoline producers and the actual situation of gasoline business activities in each period.
The standard costs in the selling price of gasoline are the maximum total costs reviewed, evaluated and built on the basis of data sources according to the provisions of the new Decree on gasoline trading.
For petroleum products, the Ministry of Industry and Trade does not announce world prices. Traders base their determination on the formula for calculating the costs constituting the petroleum price in the new Decree on petroleum trading and this Circular.
After adjusting the selling price of gasoline, the main trader of gasoline must announce the wholesale and retail prices of gasoline in the distribution system and notify the Ministry of Industry and Trade, the Provincial People's Committee, the Department of Industry and Trade and the Market Management agency where the trader has a distribution system.
Similarly, after adjusting the selling price of gasoline, petroleum distributors must announce the wholesale and retail prices of gasoline in the distribution system and notify the People's Committee of the province, the Department of Industry and Trade and the Market Management agency where the trader has a distribution system.
The draft clearly stipulates the cost of import tax on gasoline and oil; special consumption tax; premium cost, transportation cost, insurance, loss, loading and unloading and other arising costs; standard cost; foreign exchange rate to convert world gasoline and oil prices; and determining the proportion of gasoline and oil from domestic and imported sources to calculate gasoline and oil selling price; standard profit...
These are issues that petroleum distributors have been very concerned about recently.
Notably, the draft Circular also stipulates the connection of petroleum business data. Specifically, the petroleum business key traders shall connect petroleum business data (data on facilities serving petroleum business, data on petroleum distribution system, data on petroleum import - export - inventory) with the Ministry of Industry and Trade, compatible with the electronic program prescribed by the Ministry of Industry and Trade.
Based on the records and documents on the implementation of connecting petroleum business data provided by the trader, the Domestic Market Department shall transfer the records and documents on the implementation of connecting petroleum business data of the trader to the Department of E-commerce and Digital Economy.
The Department of E-commerce and Digital Economy evaluates and sends a notice confirming the completion/incompleteness of connecting petroleum business data of traders with the Ministry of Industry and Trade to the Domestic Market Department.
