Cases of liquidated planted forests

Kinhtedothi - The Government issued Decree No. 140/2024/ND-CP dated October 25, 2024 regulating the liquidation of planted forests.

Liquidation of planted forests must comply with the provisions of forestry law.

1- Due to natural disasters as prescribed by law on natural disaster prevention, including: storms, tropical depressions, strong winds at sea, whirlwinds, lightning, heavy rain, floods, flash floods, inundation; landslides, land subsidence due to rain, floods or water flows or drought; rising water, saltwater intrusion, heat, drought, natural forest fires, cold, hail, fog, frost, earthquakes, tsunamis and other types of natural disasters, incidents and catastrophes.

2- Due to pests, diseases and other organisms that harm the forest.

Cases of liquidated planted forests

The Decree clearly states that planted forests are liquidated in the following cases:

- Planted forests in the investment stage are damaged due to one of the reasons specified above and do not meet the acceptance criteria after planting according to the provisions of law on investment in forestry works.

- Planted forests after the investment phase are damaged due to one of the reasons specified above and do not meet national standards for planted forests. Only trees that are no longer able to recover will be exploited or cut down; trees that are still able to recover will be counted, counted and proposed for recovery solutions in the Planted Forest Liquidation Plan according to Form No. 04 in the Appendix to this Decree.

Form of forest liquidation

The Decree stipulates that planted forests are liquidated in the following forms:

1- Clearing and cleaning forests that have no forest product value;

2- Sale of exploited forest products for planted forests with valuable forest products.

3- Based on each type of forest in each liquidation case above, the competent authority deciding on liquidation of planted forests shall select the form of liquidation of planted forests suitable to specific local conditions and carry out exploitation in accordance with the provisions of forestry law.

Authority to decide on liquidation of planted forests

Ministers and heads of central agencies shall prescribe the authority to decide on liquidation of planted forests under the management of ministries and central agencies.

Provincial People's Councils prescribe the authority to decide on liquidation of planted forests under local management.

Principles of forest clearance

The Decree clearly states that the liquidation of planted forests must ensure the following principles: Comply with the provisions of the law on forestry; the law on public investment management and the law on management and use of public assets; Carry out the liquidation of planted forests in a timely manner, avoiding loss and waste of funds and assets; Carry out the liquidation of damaged planted forest areas and ensure that there are complete legal documents according to the provisions of the law and restore the forest after liquidation according to the provisions of the law on forestry.
