The Ministry of Natural Resources and Environment has just issued Document No. 3263/BTNMT-TNN to the People's Committees of provinces and centrally-run cities on instructions for implementing documents detailing the implementation of the Law on Water Resources.
To implement the Law on Water Resources, the Government issued Decree No. 53/2024/ND-CP detailing the implementation of a number of articles of the Law on Water Resources; Decree No. 54/2024/ND-CP regulating the practice of underground water drilling, declaration, registration, licensing, water resources services and fees for granting rights to exploit water resources. At the same time, the Ministry of Natural Resources and Environment issued 03 Circulars detailing the implementation of the Law (Circular No. 03/2024/TT-BTNMT detailing the implementation of a number of articles of the Law on Water Resources; Circular No. 04/2024/TT-BTNMT regulating the inspection of compliance with the law on water resources and appraisal and acceptance of the results of basic water resources investigation activities; Circular No. 05/2024/TT-BTNMT regulating the relocation, change of location and dissolution of underground water resources monitoring stations). The above legal documents take effect at the same time as the Law on Water Resources takes effect, July 1, 2024.
In order to implement legal documents on water resources, and at the same time organize the implementation of the Plan for implementing the Law on Water Resources 2023, the Ministry of Natural Resources and Environment respectfully requests the People's Committees of provinces and centrally-run cities to direct relevant departments, branches, districts and communes to focus on research, dissemination, training and propaganda, and widely disseminate on the media or other appropriate forms, focusing on dissemination to organizations and individuals exploiting and using water resources in the province to ensure strict implementation of the provisions of the Law, 2 Decrees and 3 Circulars detailing the implementation of the Law.
Along with that, the Ministry requested the People's Committees of provinces and centrally run cities to direct relevant departments and branches to review and complete regulations related to state management of water resources in localities to ensure compliance with the provisions of Decree No. 53/2024/ND-CP, Decree No. 54/2024/ND-CP, Circular No. 03/2024/TT-BTNMT, Circular No. 04/2024/TT-BTNMT, Circular No. 05/2024/TT-BTNMT, paying attention to regulations related to prohibited areas and restricted areas for groundwater exploitation (Official Dispatch 3201/BTNMT-TNN dated May 20, 2024); establishing and managing water source protection corridors; regulating and distributing water resources; preventing, combating and overcoming harmful effects caused by water, granting, extending and adjusting... water resource licenses; zoning of functional areas of surface water sources; determining and organizing the announcement of sanitary protection zones for domestic water intake areas; determining and adjusting minimum flows; protecting underground water...
The Ministry of Natural Resources and Environment guides localities in implementing documents detailing the implementation of the Law on Water Resources.
The Ministry of Natural Resources and Environment also requested the People's Committees of provinces and cities to continue to direct the review and urge organizations and individuals exploiting and using water resources that are required to register or have a license to promptly carry out registration procedures or submit application for a license to the competent state agency in accordance with the provisions of law; Direct the review and urge organizations and individuals exploiting and using water resources that have been granted a license and are required to pay fees for granting the right to exploit water resources but have not yet submitted the declaration dossier for calculating the fees for granting the right to exploit water resources to promptly submit the dossier for calculating the fees for granting the right to exploit water resources to the competent state agency in accordance with the provisions of law to ensure the strictness and equality of the law, avoid loss of resources and loss of State budget revenue.
Provincial and municipal People's Committees shall direct district-level People's Committees to confirm registration for underground water exploitation; commune-level People's Committees shall receive declarations of underground water exploitation by households for domestic use according to the authority prescribed in Decree No. 54/2024/ND-CP. Based on work requirements, implementation capacity, resources, actual conditions and specific situations, decide on decentralization and authorization for the Department of Natural Resources and Environment to issue, extend, adjust, reissue, approve the return, suspend, suspend, and revoke water resource exploitation licenses and underground water exploration licenses according to the provisions of the Law on Organization of Local Government.
The Ministry of Natural Resources and Environment requests the Departments of Natural Resources and Environment of provinces and cities to urgently update information on water resource licenses at https://gstnn-gp.monre.gov.vn as requested in Official Dispatch No. 638/BTNMT-TNN dated March 10, 2023 of the Ministry of Natural Resources and Environment (for Departments that have not updated) and continue to update no later than 5 working days from the date of signing and issuance for new licenses issued by the Provincial People's Committee (for Departments that have updated).
