On the afternoon of June 19, continuing the 7th session, Minister of Natural Resources and Environment Dang Quoc Khanh, authorized by the Prime Minister, presented the draft Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law.
Accordingly, the Government proposed allowing three laws related to the real estate market, namely the Land Law, Housing Law and Real Estate Business Law, to take effect from August 1, five months earlier than the National Assembly's resolution.
Two clauses of Article 200 and Article 210 of the Law on Credit Institutions are proposed to take effect early from August 1 to ensure consistency and strictness when receiving collateral from credit institutions.

Allowing the Land Law to take effect earlier will overcome shortcomings in land valuation, recovery, compensation, and resettlement support - which are the causes of officials being afraid of responsibility, avoiding, and not daring to do it, according to the Government.
At the same time, create a legal corridor, free up land resources, promote the development of the real estate market and accelerate the implementation of public investment and social housing projects.
Businesses and people are also given more favorable conditions to exercise their land user rights and protect the rights of those whose land is recovered.

However, according to the auditing agency, there are still many contents that need detailed guidance documents, so it is recommended that the Government prepare carefully, ensuring the progress and quality of detailed guidance documents.
There are opinions in the appraisal agency suggesting that the Government carefully calculate the early effective adjustment time and how early on the basis of very careful consideration of two aspects.
Firstly, the urgency of adjusting the effective date of the Law from August 1. Secondly, the level of meeting the conditions to ensure the implementation of the Law in case the Law comes into effect from August 1.
Some opinions suggested carefully considering the law coming into effect early when detailed regulations have not been fully issued. Some opinions suggested not adjusting the effective time of the Laws.
The inspection agency pointed out that as of June 18, only 1/16 documents detailing the Land Law had been issued; 7 documents detailing the Housing Law and 4 documents detailing the Real Estate Business Law had not been issued, so Mr. Thanh requested the Government to clearly report on this content.
Regarding local documents detailing the assigned content in the laws, the draft Law dossier does not have specific information about the progress, difficulties, and problems (if any) in drafting and promulgating documents in time for the early effective date of the four laws.
The Economic Committee found that amending the laws five months earlier would create great pressure in ensuring the progress and quality of documents that need to be issued, especially those issued by localities.
The Economic Committee is concerned that localities cannot complete guiding documents to implement the law, so it requests the Government to provide additional reports on the results and progress of drafting and promulgating local documents, and at the same time forecast difficulties, obstacles, and the possibility of lawsuits from investors and people in case of delayed promulgation or poor quality of documents, in order to have appropriate solutions .
