On the afternoon of October 17, the Government Inspectorate announced the conclusion of the inspection of the responsibility of performing public duties of cadres, civil servants and public employees in handling administrative procedures and providing public services to people and businesses at the Ministry of Natural Resources and Environment.
The inspection conclusion stated that the Vietnam Minerals Department ( Ministry of Natural Resources and Environment ) consulted relevant agencies before conducting field inspections to grant mineral exploitation licenses to a number of enterprises, which was not in accordance with regulations.
Specifically, the unit under the Ministry of Natural Resources and Environment carried out the process of granting mineral exploitation licenses in violation of regulations for Minh Nhat Phat Real Estate Trading Construction Company Limited to exploit granite for cladding in Khanh Hoa province; and granted mineral exploitation licenses to HAT Minerals and Construction Company Limited to exploit kaolin-feldspar in Phu Tho province.

The inspection conclusion also stated that the Ministry of Natural Resources and Environment's request for Nam Chau Son Ninh Thuan Joint Stock Company to submit documents to complete the application for a license to explore granite for cladding in the Mavieck 5 mountain area (in Phuoc Dinh commune, Thuan Nam district, Ninh Thuan) in all three first steps was not in accordance with Decree 158/2016 of the Government detailing the implementation of a number of articles of the Law on Minerals.
The mineral exploration license application of Dong Bac Construction Materials Company Limited to explore Puzolan in the Nui Le area, Quang Thanh commune (Chau Duc district, Ba Ria - Vung Tau) has an invalid attached financial report (lacking the signature of the preparer and chief accountant) but the license was still granted, which is a violation of the regulations on requirements and conditions for granting mineral exploration licenses.
The dossier granting a mineral exploitation license to Yen Bai Mineral Development Investment Joint Stock Company to exploit marble mine in Minh Tien II area (Luc Yen district, Yen Bai) was also clarified by the Government Inspectorate.
Specifically, the marble mine area had a planning period from 2008 to 2015, but the time the enterprise applied for a license was past the mineral planning period, but the application was still approved, which is not in accordance with the provisions of the Mineral Law.
In addition, in some areas where many administrative procedures arise for people and businesses such as environment, minerals, sea and islands, water resources, and mapping, the Government Inspectorate discovered that the settlement of administrative procedures has shortcomings, limitations, and defects.
In particular, the reception and response to feedback and recommendations are still slow and overdue (nearly 29% of responses in the environmental sector are overdue; 55% in the mineral sector; and 75% in the sea and island sector).
From these shortcomings and limitations, the Ministry of Natural Resources and Environment has resolved administrative procedures and provided public services to people and businesses online at a low level.
“ People and businesses still waste time traveling, meeting directly with state agencies to resolve issues, and waiting time due to slow and overdue resolution ,” the Government Inspectorate stated.
Based on the inspection conclusion, the Government Inspectorate recommends that the Ministry of Natural Resources and Environment organize a review and handle responsibilities according to Party regulations and State laws for organizations and individuals related to the existing shortcomings, limitations and shortcomings.
During the implementation of the inspection conclusion, the Ministry of Natural Resources and Environment will inspect and consider strictly handling officials and civil servants who deliberately delay, shirk responsibility, or commit acts of harassment, negativity, and inconvenience to people and businesses.
