On the afternoon of June 22, speaking with VTC News, a representative of Saigon Tourist Corporation - One Member Limited Liability Company (Saigontourist) said that this unit has filed a lawsuit against Saigon Tourist Transport Joint Stock Company at the Ho Chi Minh City People's Court for violating intellectual property rights, causing serious impacts on the company's business.
Specifically, according to Saigontourist, this enterprise has registered an exclusive trademark with the name “Saigontourist” for over 20 years. However, Saigon Tourist Transport Joint Stock Company has used the trademark “Saigontourist” and the trade name “Saigon Tourist” in violation of intellectual property laws.
This leads to customers confusing Saigon Tourist Transport Joint Stock Company as a unit of Saigontourist system, seriously affecting the reputation and brand of Saigontourist.
The Saigontourist brand was "imitated" and used by Saigon Tourist Transport Joint Stock Company for many years.
The lawsuit states that in 2004, Saigon Tourist Transport Joint Stock Company used the mark “SAIGONTOURIST” to name the company in English as “SAIGONTOURIST TRANSPORT CORPORATION”.
The trade name of Saigon Tourist Transport Joint Stock Company is pronounced exactly the same as the pronunciation of the trademark “Saigontourist” owned by Saigon Tourism Corporation. At the same time, the meaning of the phrase “Saigon Tourist” is synonymous with the trademark “Saigontourist”.
“ This may lead to serious confusion that Saigon Transport Joint Stock Company is a subsidiary of Saigon Tourist Corporation,” SaigonTourist's lawsuit stated.
According to the lawsuit, in 2006, Saigon Tourist Transportation Joint Stock Company established a branch company named “Saigontourist Travel Service Center” in Binh Thanh District (HCMC) to conduct travel services and used the sign “SAIGONTOURIST” in the company branch name. This caused serious confusion for partners and consumers that Saigon Tourist Transportation Joint Stock Company was under Saigon Tourism Corporation.
“ Saigon Tourist Corporation is a state-owned enterprise. The Saigontourist brand has been a national brand for many years in the tourism industry. The erroneous information has negatively affected the business activities and reputation of Saigon Tourist Corporation,” said a representative of Saigontourist.
During 2016 - 2017, Saigon Tourist Corporation repeatedly requested Saigon Tourist Transport Joint Stock Company to stop copyright infringement of the trade name and trademark with the sign "SAIGONTOURIST".
However, Saigon Tourist Transport Joint Stock Company did not cooperate, causing serious negative impacts on the operations of Saigon Tourist Corporation.
In August 2018, Saigon Tourist Corporation invited representatives of Saigon Tourist Transport Joint Stock Company to a meeting to resolve the matter. According to the meeting minutes, Mr. Kakazu Shogo - General Director of Saigon Tourist Transport Joint Stock Company admitted to violating intellectual property rights in the use of the "SAIGONTOURIST" sign.
Saigon Tourist Corporation has requested Saigon Tourist Transport Joint Stock Company to make a written commitment to terminate the use of the trade name and trademark "SAIGONTOURIST" and send it to this unit before September 30, 2018.
However, since then, Saigon Tourist Transport Joint Stock Company has continued to use the trade name and trademark “SAIGONTOURIST”. Saigon Tourism Corporation decided to file a lawsuit.
Regarding this incident, recently, Tan Son Nhat International Airport (HCMC) and related parties have decided to temporarily suspend passenger transport services by taxi at Tan Son Nhat International Airport for Saigon Tourist Transport Joint Stock Company from June 22 to handle violations.
According to Tan Son Nhat International Airport, this taxi company has greatly affected the reputation, image and brand of the Airport.
Previously, on June 19, the HCM City Department of Transport Inspectorate coordinated with the Tan Son Nhat International Airport Police Station (Tan Binh District Police, HCM City) and the airport security force to inspect and handle taxi drivers who violated fare regulations.
Authorities inspected a Saigon Tourist taxi and discovered an auxiliary switch under the gear lever attached to the fare meter. When the driver repeatedly pressed the switch, the fare meter increased to 10 times the actual price.
In addition, another taxi of Saigon Taxi Transport Company Limited also had an auxiliary switch located under the driver's gear lever attached to the fare meter. Each time the driver shifted into or out of gear, the fare immediately increased by VND3,000. These two cases were fined a total of VND11 million by the Inspectorate and had their taxi badges revoked for two months.
