Specific monitoring options

On the afternoon of September 5, at the National Assembly House, the National Assembly Standing Committee's (NASC) Thematic Supervision Delegation on "Implementation of policies and laws on ensuring traffic order and safety from 2009 to the end of 2023" held its first meeting. Senior Lieutenant General Tran Quang Phuong - Vice Chairman of the National Assembly, Head of the Supervision Delegation chaired the meeting.

Presenting reports on draft monitoring plans, decisions on assigning members of the Monitoring Team, and outlines of the Monitoring Team's reports, Deputy Chairman of the National Assembly's Committee on National Defense and Security Nguyen Minh Duc, Head of the Working Group, stated:

The monitoring activities aim to objectively and comprehensively assess the Government's responsibility in directing and assigning ministries, branches and localities to implement policies and laws on ensuring traffic order and safety from 2009 to the end of 2023.

Clarifying the roles and responsibilities of organizations, individuals, heads of agencies, units and awareness of law compliance in this field.

Assist the Standing Committee of the National Assembly in detecting, handling or recommending competent authorities to overcome existing problems and limitations; adjusting and handling difficulties in the implementation process; proposing solutions to perfect mechanisms, policies and laws to enhance the effectiveness and efficiency of implementation, improve the quality and efficiency of ensuring traffic order and safety in the next phase.

The subjects of supervision are the Government, ministries, branches, agencies under the Government, People's Committees of provinces and centrally run cities, relevant agencies, organizations, units and enterprises.

The monitoring team has drafted a detailed plan, outline of the monitoring report, estimated time to review reports, organize meetings of the monitoring team, time to organize workshops, seminars, explanation sessions, organize monitoring at the local level, work with the Government... and submitted it to the Standing Committee of the National Assembly for comments.

As planned, the Supervisory Delegation will report the supervision results at the September 2024 meeting of the National Assembly Standing Committee, after which the National Assembly Standing Committee will issue a resolution on the supervision results and send it to National Assembly deputies at the 8th Session.

Vice Chairman of the National Assembly Tran Quang Phuong emphasized that each monitoring topic has its own characteristics, in which the monitoring topic "Implementation of policies and laws on ensuring traffic order and safety from 2009 to the end of 2023" has a wide scope, covering all transport sectors (railways, waterways, roads, airways); the monitoring period is long from January 2009 to December 2023 (15 years), with a comprehensive and overall assessment of all areas related to traffic safety such as infrastructure investment, vehicles, rules, state management, etc.

The monitoring topic was implemented at the same time as the National Assembly gave opinions on two draft laws: the Draft Law on Road Traffic Order and Safety and the Draft Law on Roads; this should be considered the focus of this monitoring activity.

Monitoring activities also need to point out shortcomings, recommend solutions, and recommend the issuance of legal documents in the field of traffic to ensure traffic safety...

During the discussion at the meeting, opinions highly appreciated the Standing Committee of the Supervisory Delegation, the Standing Committee of the Supervisory Delegation for preparing complete and elaborate documents. Opinions also contributed opinions and proposed to complete the contents related to the report outline; scope of supervision; supervision content; supervision objects; time and progress of the Supervisory Delegation; assignment of tasks to each member of the Supervisory Delegation...

Some opinions suggest that when monitoring at the local level, we should choose specific, focused, and key monitoring such as key localities for traffic order and safety, or focus on monitoring in each field such as road traffic, waterway traffic, railway traffic, etc.; through monitoring, we should propose to soon amend related laws.

Concluding the working session, Senior Lieutenant General Tran Quang Phuong, Vice Chairman of the National Assembly and Head of the Supervisory Delegation, said that the opinions expressed were responsible in both approach and method, and valuable for the Standing Committee of the Supervisory Delegation to absorb; he highly appreciated the Standing Committee of the National Assembly's Committee for National Defense and Security for proactively coordinating with other agencies to carefully study the content and prepare conference documents for the meeting.

Mr. Tran Quang Phuong requested the Supervisory Team to supplement and perfect the detailed supervision plan more specifically; the assignment of tasks to the members of the supervisory team needs to be clear about the people, the work, and the products.

During the supervision process, it is necessary to inherit the supervision results of the Standing Committee of the National Assembly and the agencies of the National Assembly in previous terms (due to the long supervision period from 2009-2023); inherit and take advantage of the summary results to propose amendments and supplements to the Road Law and the Law on Road Traffic Order and Safety; inherit the reports of the Auditing agency and the Inspection agency on complaints and denunciations in the field of traffic order and safety.

Regarding monitoring content, it is necessary to identify the focus and key points in 5 transport areas: Road, inland waterway, maritime, railway, and aviation;

Supervise the issuance of sub-law documents after the National Assembly passes the Road Law and the Law on Road Traffic Order and Safety (expected in May 2024).

At the same time, it is also important to note that the subjects of supervision are the Government and ministerial-level agencies, focusing on members of the National Traffic Safety Committee and relevant ministries and branches; and that localities for supervision are selected according to specific characteristics, ensuring that all regions and areas are covered.

Unify the monitoring period from January 1, 2009 to December 31, 2023, focusing on when the Laws are promulgated or amended by the National Assembly.

The monitoring delegation agreed with the comments at the meeting, accordingly, the National Assembly Delegation did not organize parallel monitoring, but reported the monitoring results according to the functions and tasks of the National Assembly Delegation during the period from 2009 to the end of 2023 .
