On the morning of February 15, at the discussion session in the hall about the draft Law on Organization of Local Government (amended), Minister of Home Affairs Pham Thi Thanh Tra explained many contents that were of particular interest to National Assembly deputies.
Minister Pham Thi Thanh Tra expressed her appreciation for the dedicated, responsible, practical and extremely accurate contributions of the National Assembly deputies. She said that the Drafting Committee will closely coordinate with the National Assembly's Law Committee to receive, explain and send a report to the deputies as soon as possible, as a basis for the National Assembly Standing Committee to consider and decide to pass the bill at this session.
Local decision, action and responsibility
Minister Pham Thi Thanh Tra emphasized that similar to the Law on Government Organization, the development of the Law on Local Government Organization (amended) focuses on three core issues.
The first is decentralization, delegation of authority, and authorization. This is a key issue, aiming to implement the motto "locality decides, locality acts, locality takes responsibility," in the spirit of the General Secretary's direction. Accordingly, the Minister affirmed that clearly defining authority will create conditions for local authorities to be proactive, creative, and responsible in their activities.
The second is to remove legal bottlenecks, thereby building a tight legal mechanism to remove current obstacles in specialized laws, in order to ensure the implementation of the principles of decentralization, delegation, and authorization.

The Minister cited that currently, 177/259 specialized laws are very specifically regulating the authority of the Minister, 152 laws are very specifically regulating the authority of the Prime Minister, 141 laws are very specifically regulating the authority of the People's Council and People's Committee, and overlap with 92 laws regulating all three levels, all of which are tasks of local authorities. Therefore, if this issue is not resolved, the implementation of decentralization and delegation will encounter many difficulties.
Third is to ensure stability and connectivity. Accordingly, the draft proposes fundamental and comprehensive amendments while still ensuring immediate stability so that local authorities can operate smoothly during the process of restructuring the apparatus. This is to avoid adjustments that cause disruption and affect connectivity and unity in the implementation of streamlining the apparatus.
Innovation in local governance
Minister Pham Thi Thanh Tra also explained in detail many contents that National Assembly delegates were interested in.
Regarding the principles of organization, operation and division of authority, the Minister said that on the basis of the Constitution, Resolution 27 of the Central Executive Committee and the policies of the Politburo, the design of organization and operation of local governments will be innovated to meet practical requirements after the organizational arrangement.
She emphasized: "If we want efficiency, effectiveness and efficiency, we must adjust these issues. We are moving in that direction and we will absorb some opinions from the participating delegates to supplement and improve them, especially clarifying the issues of what it means to continue to innovate in local governance and national governance."
Elaborating on the innovation of local and national governance, the Minister emphasized the need to ensure multi-stakeholder participation in the policy-making process and promote national development. She affirmed that this is not a new issue, but a global trend and will be studied to perfect the concept.
Regarding the division of authority, the goal is to ensure the unity and consistency of the national administration through decentralization, delegation of authority and delegation of authority between central and local state agencies.
Minister Pham Thi Thanh Tra said that it is important to ensure that localities are truly proactive, creative and self-responsible in operations while adhering to the principle of "local decisions, local actions and local responsibility".
The Minister said that the draft law has tried to specifically and clearly demonstrate the principles, close relationships, interactions, responsibilities between the subjects, scope, forms of management, conditions to ensure, responsibilities between the subjects of decentralization, delegation, and authorization and the subjects receiving decentralization, delegation, and authorization. She also emphasized that the interconnectivity between the Law on Government Organization and the Law on Local Government Organization in decentralization, delegation, and authorization needs to be further improved.
In particular, the Minister emphasized that this is the basis and principle to resolve current specialized laws that are limiting decentralization, delegation and authorization. She said that she will further study the mechanism to encourage local authorities to propose decentralization.
Affirming that the determination of tasks and powers closely follows the Party's policies and the Constitution, avoiding overlapping and unclear functions and tasks between collectives and individuals, the Minister said that the draft law tries to inherit and innovate to clearly demonstrate the responsibility between individuals and collectives, between the People's Council collective, the People's Committee collective and the Chairman of the People's Committee.
Regarding the organization and model of local government, Minister Pham Thi Thanh Tra said that at present, the organization and model of local government will remain the same, because there is an overall assessment of the organizational model of the entire political system. Immediate changes may cause operational deficits. Urban governments still follow the resolution of the National Assembly and centrally-run cities can still propose on this issue.
The Minister expressed his hope that delegates would support this temporary stabilization plan, in the context that the Ministry of Home Affairs is coordinating with the Central Organizing Committee to evaluate and study the overall organizational model, including the local government system.
Finally, the Minister said that he will review and complete specific comments on adjusting the content of articles, clauses, and points of the chapters, as well as issues on legislative language, legislative techniques, and interconnection issues between the two laws (Law on Government Organization and Law on Local Government Organization)./.
