Thai Binh issues Directive to rectify and handle organizations that are slow to put land into use

According to the Directive, in recent years, state management of land in the province has had many positive changes. Land use management has become increasingly effective and efficient, gradually becoming orderly, contributing significantly to the cause of construction, socio-economic development and ensuring security and national defense.

However, in reality, there are still some cases where projects and works have had decisions on land allocation and land lease but have not or are slow to put the land into use but have not been reviewed, inspected, and handled promptly according to the provisions of law, causing waste of land and public frustration.

To rectify land management in the province and overcome the above situation, the People's Committee of Thai Binh province requested the Department of Natural Resources and Environment to preside over and coordinate with the Department of Planning and Investment, the Management Board of Economic Zones and Industrial Parks of the province, the Department of Construction, the Provincial Tax Department, the People's Committees of districts and cities to review, compile a list and management records for organizations that have been allocated land or leased land to implement projects but have not used the land for 12 consecutive months or have been delayed by 24 months as prescribed; summarize difficulties and obstacles, assess the causes (objective and subjective) of not putting land into use or delaying the use of land for investment projects.

At the same time, organize inspections and examinations of all projects and works that do not put land into use or are behind schedule in using land; strictly, thoroughly and legally handle projects and works that violate the law; resolutely reclaim land from projects and works that have terminated investment projects, have expired land use extension periods but have not yet completed investment and put land into use.

In addition, compile and make a list of projects and works with violations to publicly post on the electronic information portal of the Provincial People's Committee and send information to publicly post on the electronic information portal of the Ministry of Natural Resources and Environment before November 30 every year.

The Provincial People's Committee also requested the Department of Planning and Investment, the Management Board of Economic Zones and Industrial Parks of the province to adjust the investment progress of projects to ensure compliance with legal regulations, make a list and summarize difficulties and obstacles, assess the causes (objective and subjective) of projects with slow investment progress; advise and report to the Provincial People's Committee on solutions to remove difficulties and obstacles so that investment projects can be implemented on schedule; and limit the extension of investment progress.

In addition, inspect, supervise and evaluate investment projects according to assigned functions and tasks; advise the Provincial People's Committee to terminate investment project activities for projects that violate the provisions of investment law.

According to the Directive, the People's Committee of Thai Binh province requested the provincial Tax Department to urge and fully apply measures to enforce tax administrative decisions on projects that do not or are late in fulfilling financial obligations on land as prescribed; promptly provide information and a list of projects that do not or are late in fulfilling financial obligations on land to the Department of Planning and Investment and the Department of Natural Resources and Environment to coordinate and advise on handling measures in accordance with the provisions of law.

The Department of Construction is responsible for guiding the People's Committees at district and commune levels to strictly implement Decision No. 13/2022/QD-UBND of the Provincial People's Committee promulgating the Regulation on coordination in inspecting and handling violations of construction order in Thai Binh province; inspecting, examining and strictly, promptly and decisively handling violations of construction order in the province.

Relevant departments, branches and units, according to their assigned functions and tasks, are responsible for closely coordinating with the District People's Committees to implement measures to strengthen land management in accordance with the provisions of law.

The People's Committees of districts and cities shall strengthen land management in the area; regularly review, inspect and monitor the land use progress of projects in the area, promptly detect projects with slow investment progress, projects that are not implemented, and report to the Provincial People's Committee (through the Department of Natural Resources and Environment) for handling in accordance with the provisions of law.
