Reasonable adjustment
The Department of Planning and Investment announced the project "Dredging the channel to Ky Ha port, phase 2" which was approved by the Provincial People's Council on October 30, 2015. The total investment is nearly 199.5 billion VND, the investment source is from the central budget with targeted support, implemented from 2017 - 2020.
According to this project, the waterway from Ky Ha port to Tam Hiep port will be upgraded. The total length is 6.2km (5.9km of waterway and 0.3km of turning basin), the width of the waterway bottom is 100m, and the depth of the waterway is 9.5m below the nautical chart.
However, adjusting the General Planning for the construction of Chu Lai Open Economic Zone (EZ) to 2035, with a vision to 2050, Ky Ha port (now Chu Lai port) will be studied to become a type I port (national port).
In addition, the plan also opens a new waterway from Cua Lo area, receiving ships of 30,000-50,000 tons. Meanwhile, the current waterway to Ky Ha port needs to be adjusted and supplemented to synchronize the depth of the entire waterway from buoy 0 to Tam Hiep wharf (11km long).

The Provincial People's Committee has recognized the shortcomings and wishes to find solutions to promptly settle the accounts, end the project, and transfer it to a new investor. Proceed to socialize investment, expand project investment. If not resolved completely, investment opportunities for Chu Lai port will be difficult.”

According to Mr. Nguyen Quang Thu - Director of the Department of Planning and Investment, the project implementation time has expired. To ensure the time to complete the documents, procedures to stop the implementation, and complete the project settlement documents, it is necessary to adjust the project implementation time.
The adjusted contents do not exceed the total investment of the project. However, this adjustment has changed the investment objectives, scope, and scale compared to the approved investment policy, the project is subject to adjustment in accordance with the Law on Public Investment.
This is the basis for ending the project implementation, completing the following procedures, submitting to the Provincial People's Council for consideration, adjusting the investment policy and stopping the project implementation, as a basis for ending the project and handing over to the enterprise for socialization.
Waiting for the results of the 25th Session
The current shipping channel is only capable of receiving small and medium sized ships. This channel has been silted up, causing many difficulties for ships moving in and out of Chu Lai port. It is impossible to exploit the port's full capacity.
At the meeting on March 11, 2024 with the Provincial Economic Zones and Industrial Parks Management Board and the meeting with the Provincial Party Standing Committee on March 18, 2024, Truong Hai Group proposed to self-invest in the dredging project and committed not to ask the State to refund the money.
On May 17, 2024, the Provincial People's Committee agreed to stop the project "Dredging the channel into Ky Ha port, phase 2" and allowed THACO to carry out the project "Dredging to increase the depth of Ky Ha channel to a depth of -9.3m" (according to Official Dispatch No. 3557).
The Provincial People's Committee requested the Provincial Economic Zones and Industrial Parks Management Board to determine the technical stopping point, acceptance, payment of volume, and final settlement to complete the project in accordance with regulations.
The Provincial People's Committee submitted to the Provincial People's Council a decision to adjust the investment policy and stop implementing the project "Dredging the channel to Ky Ha port (phase 2)" at the 24th session of the Provincial People's Council, term X, but it has not been approved.
On July 29, 2024, Chairman of the Provincial People's Committee Le Van Dung requested relevant departments and branches to review and report to clarify the implementation process, from the project status to the responsibilities of the Provincial People's Committee, relevant departments and branches and limitations and difficulties, especially difficulties in implementing legal regulations related to procedures for adjusting project investment policies.
Clarify the reasons for adjusting the scale, objectives, capital structure and determine the appropriate project implementation time. All of this content will be submitted to the Provincial People's Council for consideration and agreement on adjusting the project investment policy, ensuring the legal basis for implementing the following contents.
Recently, the Ministry of Transport has requested Quang Nam to urgently complete the settlement of the old project and hand over the Ky Ha waterway to the Ministry of Transport for management. After completing the handover and receiving of the Ky Ha waterway, the Ministry of Transport will consider approving Truong Hai's proposal to dredge this waterway.
The adjustment of the investment policy for the project "Dredging the shipping channel into Ky Ha port, phase 2" will be submitted to the 25th session of the 10th Provincial People's Council for approval.
At the meeting on the afternoon of August 8, 2024 with relevant departments and branches, the Standing Committee of the Provincial People's Council unanimously approved the report and proposal to adjust the investment policy of the project "Dredging the shipping channel into Ky Ha port, phase 2" with the agreed contents of stopping the project, capital structure and implementation time after many exchanges and discussions, responsibilities, and full legal basis for the Provincial People's Council to issue a resolution.
