Conclusion of the Prime Minister chairing the conference on implementing special mechanisms for the development of Ho Chi Minh City

On December 6, the Government Office issued Notice 506/TB-VPCP on the Conclusion of the First Conference of the Steering Committee for the implementation of Resolution No. 98/2023/QH15 of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City. Accordingly, Prime Minister Pham Minh Chinh, Head of the Steering Committee, highly appreciated the Ministry of Planning and Investment as the Standing Agency, the Ho Chi Minh City People's Committee as the Working Group of Steering Committee 850 for chairing and coordinating with the Government Office, relevant ministries and agencies to prepare content and documents for this Conference of the Steering Committee. Assign the Standing Agency and the Working Group to develop a plan for the next Conference in February 2024.

The report and comments of the delegates assessed the initial results achieved in implementing Resolution No. 98/2023/QH15 of the National Assembly, thereby demonstrating increasingly better and more appropriate thinking, awareness and approaches; relevant ministries, agencies and Ho Chi Minh City are more confident and effective in building appropriate specific mechanisms and policies that have been implemented with positive results, creating motivation and confidence, contributing to promoting the development of Ho Chi Minh City in 2023 to achieve growth each month better than the previous month, each quarter higher than the previous quarter, and economic growth higher than the national average. Ho Chi Minh City has a long tradition of dynamism, creativity, distinct potential, outstanding opportunities, competitive advantages, large development space, and is expected by the whole country and international partners, but the legal framework, mechanisms, and policies are still limited compared to its position, so a specific mechanism and policy is needed for Ho Chi Minh City. To effectively implement Resolution No. 98/2023/QH15 of the National Assembly, thinking must be mature, ideology must be clear, determination must be high, efforts must be great, actions must be drastic, and tasks must be focused and key; it is necessary to analyze objective and subjective causes, lessons learned, overcome difficulties and backlogs in implementing the tasks of Steering Committee 850 in the past 4 months to set out directions and tasks for the coming time. Resolution No. 98/2023/QH15 of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City will take effect from August 1, 2023.

In addition, there are still some tasks that have not been completed on schedule assigned by the Steering Committee 850, the ministries and agencies have not yet understood the ideology, have not had the right approach, need to focus on some key tasks such as: promoting decentralization, decentralization, reforming administrative procedures, minimizing unnecessary procedures, promoting the highest efficiency of mechanisms and policies of Resolution No. 98/2023/QH15, ministries, agencies and the People's Committee of Ho Chi Minh City closely coordinate, promptly, actively discuss, exchange and propose specific, clear, higher-level, stronger solutions, the ability to turn around the situation, change the state, focus overall, focus, key points to remove obstacles and difficulties, issue feasible regulations in implementation. In particular, the People's Committee of Ho Chi Minh City needs to direct the People's Committee of Thu Duc City to focus on accelerating the settlement of procedures for approving investment policies and adjusting investment policies for projects of domestic investors using non-budgetary capital in Thu Duc City under the authority of the People's Committee of the City as prescribed in Point b, Clause 1, Article 10 of Resolution No. 98/2023/QH15 and Clause 5, Article 41 of the Investment Law. Regarding the development of a Government Decree guiding the implementation of a number of contents prescribed in Resolution No. 98/2023/QH15: The Ministry of Finance and the Ministry of Home Affairs, according to their assigned functions and tasks, shall urgently submit to the Government according to the simplified procedures and order for promulgation in January 2024, including: The Ministry of Finance: develops a draft Decree regulating loan interest, reasonable profits, payment methods, and final settlement of project implementation applying the BT contract type; Exemption of corporate income tax on income from innovative start-up activities, science and technology organizations, innovation centers and intermediary organizations supporting innovative start-ups arising in the City; exemption of personal income tax, corporate income tax of individuals and organizations with income from capital transfer, capital contribution rights to innovative start-up enterprises in the City. Ministry of Home Affairs: develop a Decree on decentralization of state management in a number of areas for Ho Chi Minh City (reforming administrative procedures, shortening the time to handle issues that have not been decentralized, delegated to the City; expanding decentralization, delegation) and contents replacing Decree No. 93/2001/ND-CP dated December 12, 2001 of the Government. In addition, the task of developing a Decree detailing the election, recruitment, management and use of cadres and civil servants working in communes, towns and ward cadres of Ho Chi Minh City, the Ministry of Home Affairs implements the direction of Deputy Prime Minister Tran Luu Quang to submit a draft Decree in November 2023 (Official Dispatch No. 9181/VPCP-TCCV dated November 22, 2023). Regarding the installation of rooftop solar power systems: the Ministry of Industry and Trade is assigned to preside over and coordinate with the Ministry of Justice to submit to the Prime Minister a program and dossier for developing a Decree regulating mechanisms and policies to encourage the development of rooftop solar power installed in private homes, offices and industrial parks; Complete and submit to the Government before December 31, 2023. It is necessary to apply more in the spirit of Resolution No. 98/2023/QH15, focusing on encouraging the development of rooftop solar power, self-sufficiency, and self-sufficiency, with Ho Chi Minh City having special mechanisms and policies compared to the general regulations of the whole country. Regarding the development of Can Gio International Transit Port, the Ministry of Transport is assigned to review and supplement the function of Can Gio International Transit Port in the process of preparing and appraising the adjustment of the Master Plan for the development of Vietnam's seaport system for the period 2021-2030, with a vision to 2050, in accordance with Resolution No. 81/2023/QH15 dated January 9, 2023 of the National Assembly on the national master plan for the period 2021-2030, with a vision to 2050; submit to the Prime Minister in January 2024.
