On the morning of January 15, the 15th National Assembly opened an extraordinary session to consider a number of urgent issues, including the draft revised Land Law.
After four postponements, the draft revised Land Law was submitted by the Government to the National Assembly at the 4th session at the end of 2022, expected to be passed through the three-session process. However, on the morning of November 22, 2023, with 453/459 delegates present in agreement, the National Assembly agreed to adjust the time for passing the draft Law from the 6th session to the nearest session.
The reason is that the bill still has some major contents and policies that need further research to design optimal policy options. Reviewing and perfecting the draft also needs more time to ensure its constitutionality, legality and consistency with the legal system.
The draft at that time had 14 issues with two options that needed to be consulted by the National Assembly. Among them, the issues that received the most comments from experts and National Assembly deputies and had to be continuously revised through the drafts were land recovery by the State, land valuation methods, and applicable cases and conditions.
Major contents with different opinions include: Rights and obligations of economic organizations and public service units using land for annual rental payment; principles of establishing and approving land use planning at all levels; organization of implementation of land use planning and plans, allocation of provincial-level land use targets, district-level land use targets; relationship between land recovery cases and agreements on receiving land use rights to implement socio-economic development projects not using state budget capital; Land development fund; Organization of land fund development.

In the announcement on January 13, the Secretary General of the National Assembly said that after being received and revised, the latest draft of the revised Land Law consists of 16 chapters and 260 articles, with 5 articles removed and 250 articles amended and supplemented compared to the draft submitted to the National Assembly at the 6th session. Based on discussion opinions and through review, the agencies agreed to revise and complete 18 contents on major issues and are eligible to be submitted to the National Assembly for consideration and approval at this extraordinary session.
National Assembly Chairman Vuong Dinh Hue said that this is a very important bill, with profound impacts on all aspects of the economy, society, people, and business community in the short and long term. The drafting and reviewing agency has prepared very carefully and elaborately, consulted experts and scientists many times, and organized a public consultation with 12 million comments.
The National Assembly Standing Committee also gave official comments five times. The Chairman and Vice Chairmen of the National Assembly, along with the Prime Minister and Deputy Prime Ministers, also had many working sessions with agencies on various contents of the draft. To date, the draft law has been basically completed, institutionalized, and covers the spirit of Resolution 18 of the Central Committee, the Constitution, and the Party Platform.
During the three-day extraordinary session, the National Assembly will also consider and approve a draft Resolution on a number of specific mechanisms and policies to remove difficulties and obstacles, speed up the implementation of National Target Programs; supplement the Medium-Term Public Investment Plan of the central budget for the 2021-2025 period from the general reserve fund corresponding to the increased central budget revenue in 2022 for public investment tasks and projects; and supplement the Medium-Term Public Investment Plan for Vietnam Electricity Group from the reserve fund of the Medium-Term Public Investment Plan.
