Hai Phong reclaims 26 hectares of public land in Do Son to develop tourism

On November 24, Chairman of Hai Phong City People's Committee Nguyen Van Tung inspected the field management of 3 public land plots in Van Huong Ward (Do Son District) to prepare for land recovery, site clearance, and land use rights auction documents to serve tourism development, after the Prime Minister approved the General Planning of Hai Phong City to 2040, with a vision to 2050 in Decision No. 323/QD-TTg dated March 30, 2023.

Chairman of Hai Phong City People's Committee Nguyen Van Tung and representatives of departments, branches and units inspected 3 public land plots in Van Huong Ward (Do Son District) to serve land recovery, auction and tourism development.

Accordingly, the 3 public lands are all located in Zone 1 and Zone 2 of Van Huong Ward with a total area of ​​over 26 hectares, including: the land of the Do Son Rehabilitation - Occupational Disease Treatment Center under the Ministry of Construction in Zone 2 (this land was transferred by the Prime Minister to Hai Phong City for management in August 2023); Cay Dua area and the old Van Huong ward area with an area of ​​over 3 hectares; Vung Xec area and area 203 with an area of ​​20 hectares; the land from Hoa Phuong Hotel to the land bordering the Conference and Training Center for Trade Union Cadres under the Vietnam General Confederation of Labor in Zone 1 with an area of ​​3 hectares.

Through inspection, the working group of the Chairman of Hai Phong City People's Committee determined that there are 105 households operating services here. The households had ended their land lease contracts for business many years ago. However, until now, the households continue to use the land and have not returned the land to Do Son District. Some households have even arbitrarily transferred it to others to use until now.

Most of the households built restaurants and motels without construction permits and built them in a manner inconsistent with the granted construction permits; and did not fully fulfill their financial obligations regarding land. Thus, the above households violated the Land Law of 1993, 2003 and 2013, and the Construction Law of 2003 and 2014.

The Coconut Tree Area and the old Van Huong Ward Area, which are over 3 hectares wide, will be demolished and reclaimed.

Consider the responsibility of relevant groups and individuals

The Chairman of Hai Phong City requested Do Son District to review, terminate, and cancel documents of agencies that have signed illegal agreements with households regarding permission to use premises, business locations, and investment cooperation in the above areas; handle public assets under management according to authority; handle architectural assets of households violating in the above areas, and create a clean site before organizing auctions for the above land plots.

At the same time, review, prepare records of administrative sanctions, prepare records of enforcement of decisions on administrative sanctions according to the provisions of law for households that intentionally do not hand over the land; collect financial obligations on land and other illegal profits of households according to regulations.

The entire 9,000 m2 neighborhood, which is part of the land managed by the Ministry of Construction in Zone 2, Van Huong Ward (Do Son District), which has been handed over to Hai Phong for management by the Prime Minister, will be demolished and reclaimed to serve land auctions and tourism development.

Regarding the responsibility of the Do Son District government for lax management of land, construction and public assets, and failure to thoroughly handle violations, Chairman Nguyen Van Tung requested the Do Son District Party Committee to organize an inspection and review the responsibility of relevant collectives and individuals.

In addition, the petition of the households requesting the city and district to support the construction works and architectural objects that the people have invested in and built on the above land plots was rejected by the leaders of Hai Phong City People's Committee because there was no legal basis for consideration and resolution.
