New impetus to help promote social housing

DNVN - The Government's issuance of the Decree detailing a number of articles of the Housing Law on the development and management of social housing in Decree 100/2024/ND-CP, dated July 29, is an important step, creating a new "push" to promote social housing.

According to Mr. Nguyen Van Dinh - Chairman of the Vietnam Association of Real Estate Brokers (VARS), the Government's issuance of the Decree detailing a number of articles of the Housing Law on the development and management of social housing in Decree 100/2024/ND-CP, dated July 29, is an important step, creating a new "push" to open up social housing.

Decree 100/2024/ND-CP has detailed Clause 2, Article 83 of the 2023 Housing Law, guiding the Provincial People's Committee to decide whether the investor of a commercial housing construction investment project must reserve a part of the residential land area in the project that has invested in building a technical infrastructure system to build social housing (NƠXH). Or arrange the NƠXH land fund that has invested in building a technical infrastructure system in a location other than the scope of the commercial housing construction investment project in that urban area.

The law also stipulates that investors can pay money equivalent to the value of the land fund invested in building technical infrastructure systems to build social housing in special, type I, type II and type III urban areas, based on Government regulations to ensure convenience in the implementation process. The process of implementing investment procedures for social housing projects is also significantly shortened, helping investors save time and costs in project implementation.

Mr. Nguyen Van Dinh - Chairman of VARS affirmed that Decree 100/2024/ND-CP is an important step to promote the development of social housing.

Clause 2, Article 22 of the Decree has specified in detail the components constituting the total investment cost of constructing the social housing area. This is the basis for calculating the maximum profit equal to 10% of the total investment cost of constructing the social housing area according to the Housing Law 2023.

At the same time, the project investor can also have additional profits from the area of ​​​​business, commercial and residential buildings - accounting for a maximum of 20% of the total residential land area in the project that has invested in building technical infrastructure systems.

Regarding the selection of investors for social housing construction investment projects through bidding, Clause 5, Article 21 of the Decree also clearly stipulates the evaluation criteria for the capacity and experience of investors implementing social housing construction investment projects.

In addition to regulations encouraging investment in the social housing sector, Decree 100/2024/ND-CP also details the conditions for enjoying social housing support policies in a more relaxed manner for those with legitimate needs to access this type of housing.

Regarding the conditions for enjoying social housing policies, Clause 1, Article 29 stipulates that the case of not having a house of one's own is determined when the subject specified in Clause 1, Article 77 of the Housing Law and the subject's spouse (if any) are not named in the certificate of land use rights and ownership of assets attached to land in the province or centrally-run city where the social housing project is located at the time of submitting the application for purchase or hire-purchase registration.

This means that the subjects specified in Clauses 1, 4, 5, 6, 8, 9 and 10, Article 76 of the Housing Law who do not yet own a house in the province or centrally-run city where there is a social housing project will be allowed to buy, hire-purchase and rent.

Thus, people who want to buy social housing and are living with a large family will not have to waste time separating their household registration to have the government confirm that they do not own a house. State management agencies also have a legal basis to implement and eliminate the fear and responsibility of local management officials in confirming people's home ownership.

Decree 100/2024/ND-CP is in line with the expectations of businesses and people, especially people with average incomes, paying taxes to the State.

In addition, the Decree also stipulates the time limit for competent authorities to confirm information on housing ownership of registrants and income conditions. This answers the question "when will people be confirmed?"

Specifically, within 7 days, the office or branch of the land registration office will have to confirm the information of the registrant who does not own a house and is not listed in the red book in the locality where the social housing project is located. Also within 7 days, the People's Committee at the commune level will confirm the income conditions for the investor to register to buy or rent-purchase social housing.

Social housing investors are no longer required to reserve 20% of their area for rent, and can only sell after 5 years. This greatly “unties” the rental price, which is currently public on information portals, but is still more expensive than the average price for people to rent themselves, not to mention the very complicated legal procedures.

Whether to buy or rent should be decided by the market, which will help investors be more confident in developing social housing.

Decree 100/2024/ND-CP also stipulates that for subjects specified in Clauses 5, 6 and 8, Article 76 of the Housing Law, income conditions must be ensured. Accordingly, the income conditions for enjoying social housing support policies are officially "relaxed".

Workers with an income of no more than 15 million VND will be allowed to buy, rent, or lease-purchase social housing, instead of the maximum of 11 million VND as previously stipulated. For married people, the condition for renting or buying this type of house is that the couple has a maximum income of 30 million VND per month.

“We believe that these new regulations are “reasonable”, in line with the expectations of businesses and people, especially middle-income people who pay taxes to the State,” the Chairman of VARS affirmed.
