What can businesses do to minimize the risk of trade defense investigations from the UK market? Correcting the deadline for receiving applications for exemption from trade defense measures

On the morning of October 11, in Ho Chi Minh City, the Ministry of Industry and Trade organized the first Trade Defense Forum with the theme "Trade Defense: Strengthening endogenous capacity, promoting sustainable growth".

The event included more than 150 delegates, including leaders of the Trade Defense Department, leaders of the Department of Industry and Trade of provinces and cities (Binh Duong, Ho Chi Minh City, Binh Phuoc, An Giang, Dong Thap, Tien Giang, Tra Vinh, Bac Lieu); leaders of relevant units under the Ministry of Industry and Trade, industry associations, manufacturing, import-export, and trading enterprises... attending the conference.

In his opening speech, Mr. Trinh Anh Tuan - Director of the Department of Trade Defense (Ministry of Industry and Trade) emphasized the role of trade defense in the context of economic integration with many fluctuations as today. Trade defense tools such as anti-dumping, anti-subsidy and self-defense taxes are used appropriately, in accordance with legal regulations and international commitments, contributing to supporting domestic manufacturing industries to develop sustainably in an environment of fair competition. Thereby ensuring jobs and income for workers, while bringing added value to the economy and enhancing the capacity of domestic entrepreneurs.

“The appropriate handling of foreign trade defense investigations into Vietnam's export goods has also helped many industries and businesses avoid risks and negative impacts of trade defense measures applied by export markets, thereby helping businesses maintain their markets and increasingly participate more deeply in regional and global value chains,” Mr. Trinh Anh Tuan emphasized.

By the end of September 2024, Vietnam had conducted 30 trade defense investigations and was maintaining the application of 22 trade defense measures on imported goods. The total annual revenue of domestic manufacturing enterprises participating in trade defense cases is estimated at VND475 trillion. The number of direct employees working at enterprises is about 36,000 people. Annual budget revenue from trade defense taxes is from VND1,200 to VND1,500 billion.

For export industries, the satisfactory handling of trade defense investigations has helped businesses take advantage of and maintain the results brought about by the international economic integration process. Up to now, Vietnam's exports have faced 263 trade defense investigations from 25 markets. Of which, the leading cases are anti-dumping investigations (144 cases), followed by self-defense cases (53 cases), anti-circumvention of trade defense measures (38 cases) and anti-subsidy cases (28 cases).

Although the number of foreign trade defense investigations into Vietnam's export goods tends to increase, thanks to the initiative of enterprises as well as the active support of the Ministry of Industry and Trade and relevant agencies, many cases have achieved relatively positive results such as enterprises not being subject to trade defense taxes or being subject to low taxes, thereby continuing to maintain export markets.

The Director of the Trade Defense Department said that under the close direction of the leaders of the Ministry of Industry and Trade, trade defense work will continue to be promoted with the goal of ensuring a healthy competitive environment, helping domestic manufacturing industries develop and create more added value for the economy. Trade defense investigations on imported goods will be conducted on the principles of fairness and transparency in accordance with legal regulations and international commitments.

“In the coming time, the Trade Defense Department is committed to continuing to support businesses by perfecting trade defense tools, improving investigation and lawsuit handling capacity, and promoting international cooperation to enhance protection for domestic manufacturing industries. We believe that with close coordination between the State and the business community, as well as the support of interested organizations and individuals, Vietnam will continue to improve its competitiveness, affirm its position on the global trade map and achieve sustainable development goals,” said Mr. Trinh Anh Tuan.

At the forum, speakers from relevant units under the Ministry of Industry and Trade updated information on the situation of investigation and application of trade defense measures on imported goods; the situation of application of foreign trade defense measures on Vietnamese exports.

At the same time, introduce to the business community some legal regulations on trade defense expected to be supplemented and amended in 2024, guide how businesses submit and receive results of processing dossiers for trade defense cases in the electronic environment, introduce and guide businesses to exploit information and data of the early warning system.

Along with that, information on the effectiveness of handling foreign trade defense investigations in ensuring sustainable exports; the effectiveness of trade defense measures on domestic manufacturing industries.
