Kinhtedothi – On the morning of December 20, the Office of the President held a press conference to announce the President’s Order on new laws passed by the National Assembly. Deputy Head of the Office of the President Pham Thanh Ha chaired the press conference.
At the press conference, Deputy Head of the Office of the President Pham Thanh Ha announced the President's Order promulgating the Law on Cultural Heritage; Law on Value Added Tax; Law on Urban and Rural Planning; Law on Notarization; Law on Trade Unions; Law on Prevention and Combat of Human Trafficking; Law on Fire Prevention, Fighting and Rescue; Law on Data; Law on Amending and Supplementing a Number of Articles of the Law on Securities, Law on Accounting, Law on Independent Auditing, Law on State Budget, Law on Management and Use of Public Assets, Law on Tax Administration, Law on Personal Income Tax, Law on National Reserves, Law on Handling of Administrative Violations.
Notaries can only practice until they are 70 years old.
At a press conference on the new points of the 2024 Notary Law, Deputy Minister of Justice Nguyen Thanh Tinh said that the Law has removed the provision on exemption from notary training, instead all subjects wishing to be appointed as notaries must participate in notary training. However, the notary training time is reduced by half for some subjects with high legal qualifications and time holding certain specific legal positions.
The law stipulates that all subjects must undergo a 12-month probation. Notably, the Law adds a provision that notaries can only be appointed or reappointed to people under 70 years old, and notaries can only practice until they turn 70. This is a very new provision.
In addition, the Law has transitional provisions, according to which, notaries over 70 years old who are practicing notary at the time this Law comes into effect may continue to practice notary for a maximum period of two years from the date this Law comes into effect.
Another new point informed by Deputy Minister of Justice Nguyen Thanh Tinh is that the Law allows the establishment of notary offices in the form of private enterprises in district-level administrative units with low population density, underdeveloped infrastructure and services, and difficulties in establishing notary offices in the form of partnerships. The list of district-level administrative units that are allowed to establish notary offices in the form of private enterprises is prescribed by the Government.
The Law also replaces the current law's provisions on transferring notary offices under the form of a partnership with provisions on transferring all capital contributions of all general partners of the notary office.
In cases of termination of partnership membership, sale of notary office, or termination of notary office operations, the partnership notary or head of the notary office in the form of a private enterprise may only continue to partner in another notary office or become head of a notary office in the form of a private enterprise after a period of at least 2 years.
In addition, the Law also adds a new form of practice, which is a notary public working under a labor contract at a notary office.
The new Notary Law takes effect from July 1, 2025 and replaces Notary Law No. 63/2015.
Obligation to pay 2% of union fees from 2025
Introducing the basic contents of the 2024 Trade Union Law, Vice President of the Vietnam General Confederation of Labor Ngo Duy Hieu said that the 2024 Trade Union Law has added the right to establish, join and operate trade unions for "workers without labor relations"; regulated the right to join and operate trade unions for "workers who are foreign citizens" (without the right to establish). Added regulations on joining the Vietnam Trade Union of employees' organizations at enterprises; more specific regulations on the organizational system of the Vietnam Trade Union and international cooperation on trade unions; supplemented and clarified prohibited acts.
In the newly passed law, ensuring trade union finances is an important content. Accordingly, the regulation that agencies, organizations, units, enterprises, cooperatives, and cooperative unions of all economic sectors, regardless of whether a trade union has been established or not, must be obliged to pay trade union fees equal to 2% of the salary fund used as the basis for compulsory social insurance for employees, remains unchanged.
At the same time, supplement regulations on considering exemption, reduction, and suspension of trade union fee payment for enterprises, cooperatives, and cooperative unions when facing difficulties; supplement and clarify tasks of spending trade union fees; supplement regulations on distributing trade union fees to employee organizations at enterprises.
The 2024 Trade Union Law has added provisions to ensure publicity and transparency, further strengthening the inspection, examination, auditing and supervision of competent authorities in the management and use of trade union assets and finances, while ensuring the principle of financial autonomy of trade unions.
Regarding the content of publicizing trade union finances, Vice President of the Vietnam General Confederation of Labor Ngo Duy Hieu said that the Law has a new provision that every two years the Vietnam General Confederation of Labor must report to the National Assembly on the issue of revenue and expenditure, management and use of trade union finances. In addition, every two years, the State Audit will audit trade union finances to report to the National Assembly.
Regarding the draft Decree detailing 1 Law amending 9 Laws (Law amending and supplementing a number of articles of the Securities Law, the Accounting Law, the Independent Audit Law, the State Budget Law, the Law on Management and Use of Public Assets, the Tax Administration Law, the Personal Income Tax Law, the National Reserve Law, the Law on Handling of Administrative Violations), a representative of the Ministry of Finance said that according to the latest draft prepared for submission to the Government, only business individuals and business household owners with overdue tax debts of VND50 million or more for more than 120 days will be temporarily suspended from leaving the country. According to the impact assessment, individuals and business households with overdue tax debts of over VND50 million are 81,000 people; this regulation is also equivalent to that of other countries after conversion; it is an effective and efficient measure in tax management.
