Also attending the citizen reception were representatives of the Legal Committee of the City People's Council; leaders of the Department of Natural Resources and Environment; City Inspectorate; Office of the National Assembly Delegation and the City People's Council; Office of the City People's Committee; representatives of the People's Committee of Thach That district, the People's Committee of Kim Quan commune; representatives of the People's Committee of Dong Anh district, the People's Committee of Kim Chung commune.
Citizen Nguyen Thi Van at No. 1, Group 5, Village 84, Kim Quan Commune, Thach That District, Hanoi City has a petition reflecting that she has completed her financial obligations to be paid from 2022 for land plot No. 36 , area 150m2 in Cong Trang garden area, Kim Quan Commune, Thach That District, but has not yet been granted a Land Use Rights Certificate.
The process of handling the petition is as follows: On February 22, 2002, the People's Committee of Kim Quang Commune had a Minutes of exchanging residential land with Ms. Nguyen Thi Van to carry out the expansion of Kim Quan Communal House. The People's Committee of Kim Quan Commune took the 150m2 land plot of Ms. Nguyen Thi Van next to the communal house to expand, repair and protect the communal house corridor and returned to Ms. Van the land plot in lane 3 of Cong Trang garden area, Kim Quan Commune, Thach That District.
On November 12, 2004, the District People's Committee issued Decision No. 2067/QD-UBND dated November 12, 2024 allocating land for resettlement to Ms. Nguyen Thi Van at the above address.
On September 18, 2020, the Office of the City People's Committee issued Notice No. 398/TB-VP on the conclusion of Vice Chairman of the City People's Committee Nguyen Quoc Hung at a working session with leaders of Thach That district to resolve a number of existing issues and problems related to land management in the area, including the Kim Quan industrial cluster. The Vice Chairman of the City People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with the People's Committee of Thach That district and related units based on the provisions of land law over the periods to inspect and carefully review the basis and legal basis of land allocation for resettlement to households, area limits and financial obligations according to regulations (if allocated). On that basis, advise and propose, report to the City People's Committee for consideration and direction.
On February 15, 2022, Ms. Nguyen Thi Van fulfilled her financial obligations to the Tax Department of Thach That - Quoc Oai area with an amount of nearly 450 million VND but has not been granted a Land Use Rights Certificate. Ms. Nguyen Thi Van submitted a petition to the People's Committee of Thach That district but it has not been resolved, so she sent a petition to the Standing Committee of the City People's Council.
After listening to the progress report of the units, Chairman of the City People's Council Nguyen Ngoc Tuan commented that the above incident was the responsibility of the Department of Natural Resources and Environment and the People's Committee of Thach That district for not fully fulfilling their responsibilities in resolving the citizen's petition.
The Chairman of the City People's Council requested the City People's Committee to direct the Department of Natural Resources and Environment, the City Inspectorate and specialized agencies together with the People's Committee of Thach That district to thoroughly resolve citizens' petitions in accordance with the provisions of law; At the same time, request Thach That district to immediately carry out the procedures for granting Certificates and report the results of the settlement to the Standing Committee of the City People's Council in October 2024. Review any cases in the area that have not yet been granted Certificates of Land Use Rights for early handling and settlement, ensuring the rights of the people.
Next, Chairman of the City People's Council Nguyen Ngoc Tuan received citizens following the petition of Mr. Ha Quang Thuyet (son of Mr. Ha Van Dao) in Bau village, Kim Chung commune, Dong Anh district, Hanoi city.
Accordingly, in the petition, Mr. Ha Quang Thuyet requested to consider and resolve the problem in granting the family a Certificate of Land Use Rights for plot number 85, map sheet number 3 in Bau village, Kim Chung commune, Dong Anh district.
The incident unfolded as follows: in the period 2003-2005, the leaders of Bau village arbitrarily held a meeting with the people to sign a road construction contract and handed over this land to Bac Thang Long Trading and Construction Company Limited - directly to Mr. Ha Van Dao. Due to not having money to pay Bac Thang Long Trading and Construction Company Limited according to the contract for building a residential road, on April 12, 2005, the leaders of Bau village agreed to pay the Company with land belonging to the Bau village football field with the following dimensions: 80m long in the East, 80m long in the West, 15m long in the North, 34m long in the South, with an area of 1,774 m2 .
The land belongs to plot number 85, map sheet number 3 in Bau village, Kim Chung commune, Dong Anh district. The entire land has been managed and used by Mr. Ha Van Dao since 2007 for residence and business.
On February 12, 2019, Kim Chung Commune People's Committee issued Report No. 221/BC-UBND on the existence of the Bau village road construction project in the period of 2003-2005, stating that the origin of the land is specialized land (old football field) managed by the Commune People's Committee. According to the detailed planning of the new Kim Chung urban area at a scale of 1/500, the above land has the function of residential land.
It is true that Mr. Ha Van Dao constructed the village road in Bau village, through the legal entity of Bac Thang Long Trading and Construction Company Limited, signed a contract with the leaders of Bau village. In fact, Mr. Ha Van Dao mortgaged and transferred many of his family's lands to get advance capital for road construction.
The content of the Bau village road construction project has existed since 2005, but it was not until January 2019 that the village leaders reported and discussed with the Commune People's Committee. Following the direction of the Kim Chung Commune Party Committee at the meeting on January 29, 2019, the Kim Chung Commune People's Committee reported the content of the Bau village road construction project in the period of 2003-2005. On January 21, 2020, the Dong Anh District People's Committee reported and requested the Department of Natural Resources and Environment to guide the district on solutions to remove difficulties and obstacles and directions to resolve the incident...
To date, the assigned units have not reported the results of implementation. On the other hand, because the case has been going on for many years without being resolved, citizens continue to send petitions to the Standing Committee of the City People's Council requesting consideration and direction to resolve the issue to ensure the legitimate rights and interests of the family.
At the citizen reception, the authorities reviewed and clarified the records and documents related to the case. After listening to the report, Chairman of the City People's Council Nguyen Ngoc Tuan requested the People's Committee of Dong Anh district to find a solution to remove difficulties, completely resolve the citizen's case, and report to the Standing Committee of the City People's Council in November 2024.
The Chairman of the City People's Council assigned the People's Council's Legal Committee, the Office of the National Assembly Delegation and the City People's Council, and the City Citizen Reception Committee to monitor, urge and supervise the settlement, synthesize and report to the Standing Committee of the City People's Council according to regulations.
