Regarding the press sector, in 2023, the Ministry of Information and Communications will focus on fundamentally resolving and rectifying the situation of "newspaperization" of magazines and general electronic information sites.
Specifically, the Ministry of Information and Communications tightened the licensing of general information websites and social networks. From the beginning of the year to the end of March 2023, the Ministry of Information and Communications granted 2 licenses for general information websites (down nearly 70% compared to the same period last year), and 16 licenses to establish social networks (down more than 55% compared to the same period last year).
The Ministry of Information and Communications has directed specialized units to coordinate with local Departments of Information and Communications to strictly handle cases showing signs of "newspaperization", administratively sanctioning 100 cases with a total fine of more than 1.5 billion VND for general electronic information sites and social networks; revoking the right to use licenses for 3 cases; suspending 70 domain names, preventing more than 45 cases of domain names violating the field of electronic information.
According to the Ministry of Information and Communications, there is still a situation of "newspaperization" of general electronic information sites (general electronic information sites that operate like newspapers, confusing readers, shown in the form, content of the site, to the organization of human resources and professional activities).
The Ministry reviewed, evaluated, and compiled a list of 77 organizations and enterprises that established general information websites and social networks with signs of "newspaperization" for close monitoring, correction, and handling. Strengthened inspection and handling of violations of general information websites and social networks.
Coordinate with the Department of Information and Communications of Hanoi and Ho Chi Minh City to invite 34 organizations and enterprises to set up general electronic information pages and 43 enterprises providing social networking services belonging to the group of subjects showing signs of "newspaperization" to work.
However, according to the Ministry of Information and Communications, there is still a situation of "newspaperization" of general electronic information sites (general electronic information sites that operate like newspapers, confusing readers, shown in the form, content of the site, to the organization of human resources and professional activities).
The reason is that the legal regulations are not strict and complete, leading to a situation where some news aggregators and social networks take advantage of loopholes to "newspaperize", self-produce news articles or provide content that is confusing as press agencies. Handling violations is difficult, especially in cases of repeated violations, requiring suspension or revocation of licenses.
The situation of copyright infringement on general electronic information sites has decreased, but it still exists due to limited awareness and understanding of the law on copyright and related rights, leading to frequent acts of copyright and related rights infringement... There are cases of intentional infringement.
The awareness of law compliance of some organizations and enterprises operating general information websites and social networks is poor, even intentionally violating many times, making it difficult for state management agencies to handle and revoke licenses immediately because of the handling process according to regulations; regulations are not strict enough, sanctions are lacking, and low fines are not enough of a deterrent.
In the coming time, the Ministry of Information and Communications will complete and submit to the Government for promulgation a new decree on the management, provision and use of Internet services and online information. This will institutionalize the concept of “newspaperization”, focusing on amending and supplementing regulations on the management of news sites, social networks, domain names, social media activities in cyberspace, and cross-border platform management, etc.
The units will review all licenses of general electronic information sites, specify and clearly define the scope of information provided by each site, and require each category to be clearly stated in the license. Complete data of the licenses of general electronic information sites of 63 provinces and cities will be posted on mic.gov.vn.
The Ministry will direct specialized units to coordinate with the Departments of Information and Communications and relevant agencies to strengthen screening, monitoring, inspection, examination, and post-inspection to detect violations and strictly handle violations, especially violations of "newspaperization" of electronic news sites and social networks, and posting fake news and toxic information online.
