Recently, the National Assembly officially passed the Law on Road Traffic Order and Safety with 79.84% of the total number of delegates participating in the vote in favor.
The Law prescribes road traffic rules; road vehicles; drivers of vehicles participating in road traffic; commanding and controlling road traffic; patrolling and controlling road traffic order and safety; handling road traffic accidents; and state management of road traffic order and safety.
One of the issues that the public is very interested in is the regulations on school buses, especially at the end of May, there was a heartbreaking incident when a 5-year-old preschooler was left on a school bus, resulting in the child's death.
To limit such tragic incidents, the Law on Road Traffic Safety has devoted 1 article with 6 provisions on ensuring road traffic order and safety for cars carrying preschool children and students. Notably, the law sets out specific requirements to avoid the situation of forgetting children in cars because in reality there have been heartbreaking incidents that have caused social outrage.
Specifically, Article 46 stipulates that vehicles used for transporting preschool children and students must have equipment to record images of preschool children and students. They must be equipped with devices that can warn against leaving children in the vehicle. The vehicle must not be more than 20 years old and must have paint colors according to government regulations.
Cars carrying preschool children or primary school students must have age-appropriate seat belts or use vehicles with age-appropriate seats as required by law.
The Law on Road Traffic Order and Safety stipulates that school buses must have image recording equipment and equipment with warning functions to prevent children from being left in the vehicle.
When picking up and dropping off preschool children and primary school students, there must be at least one manager on each vehicle to guide, supervise, maintain order and ensure the safety of preschool children and primary school students throughout the trip.
In case of vehicles with 30 seats or more and carrying more than 29 primary school students and preschool children, there must be at least 2 managers on each car.
The manager and driver are responsible for checking preschool children and primary school students when getting off the vehicle; preschool children and primary school students must not be left on the vehicle when the manager and driver have left the vehicle.
Drivers of cars transporting preschool children and students must have at least 2 years of experience driving passenger transport vehicles.
The law also stipulates that educational institutions must develop procedures to ensure safety when transporting and picking up preschool children and students; and provide instructions for drivers and managers of preschool children and students to fully understand and properly implement the procedures.
Must be responsible for ensuring order and road traffic safety when organizing transportation for preschool children and students of that educational institution.
Vehicles transporting preschool children and students are given priority in organizing traffic flow, regulating traffic, arranging stops and parking in school areas and at points on the route to transport preschool children and students.
The passed law has a structure of 8 chapters with 89 articles and will take effect on January 1, 2025 .
