ANTD.VN - Through inspection and examination results, the Ministry of Finance found that some Lottery Companies still have investments in industries and professions not directly related to lottery business activities.
The Ministry of Finance has just sent a document to the People's Committees of provinces and centrally-run cities regarding compliance with legal regulations on lottery business.
Accordingly, implementing the 2024 inspection and audit plan, the Ministry of Finance inspected compliance with legal regulations on lottery business at 09 Lottery Companies (XSKT Companies) and conducted specialized lottery inspections at 08 XSKT Companies.
The results show that some Lottery Companies still have shortcomings and limitations in their operations, including: Procedures and regulations on organizing operations, lottery drawing rules issued without proper authority, incomplete and not updated with legal documents;
Some Lottery Companies still have investments in industries and professions not directly related to lottery business activities;
The composition of the Lottery Supervisory Board has not been specifically regulated, and there has been no notice of change; The content of the lottery agency contract does not fully comply with the provisions of law;
The establishment and use of the Risk Reserve Fund for Reward Payments are not yet in accordance with the provisions of Decree No. 122/2017/ND-CP; The charter capital of Lottery Companies is not in accordance with the production, business and investment development plans as prescribed by law.

The Ministry of Finance pointed out many shortcomings in the operations of Lottery Companies. |
To ensure that lottery business activities in provinces and centrally run cities comply with the provisions of law, the Ministry of Finance requests the People's Committees of provinces and centrally run cities, as the representative agencies of the ownership of the Lottery Company, to direct local authorities and the Lottery Company to strictly implement the provisions of law on lottery business.
In particular, the Ministry of Finance noted a number of contents such as: Strengthening inspection and supervision of the business activities of the Lottery Company in the area according to the provisions of law to promptly detect, correct and handle violations in the business activities of the enterprise;
Review, supplement and complete to issue under authority the Charter on organization and operation, Financial management regulations of Lottery Company in accordance with authority and legal regulations; review and supplement the composition of the Lottery Supervisory Council in accordance with prescribed composition;
The People's Committees of provinces and cities are also required to direct and supervise Lottery Companies to divest State capital invested in non-core sectors in accordance with the provisions of law;
Assess the required charter capital of the Lottery Company to ensure compliance with the provisions of the Law on Management and Use of State Capital Invested in Production and Business at Enterprises and related guiding regulations;
The Ministry of Finance also requested the People's Committees of provinces and cities to direct Lottery Companies to: Report to competent authorities to synchronously issue regulations on organization and operation, financial management regulations; Review, supplement and complete the Regulations, Rules for participation in the prize, Rules for drawing and opening prizes to ensure compliance with current laws;
Comply with the provisions of law on lottery business and investment of state capital outside the enterprise; Strictly implement the provisions of law on the process of organizing lottery drawing;
Establish, manage and use the Bonus Risk Reserve Fund in accordance with regulations; Review and report to the People's Committee of the province or city on the charter capital level in accordance with the production, business and investment development plan in accordance with the provisions of law;
Restructuring state capital according to the state capital divestment roadmap to ensure effective use of state capital and avoid the possibility of capital loss.
"Propose that the People's Committees of provinces and cities coordinate and ensure that lottery business activities of the Lottery Company comply with legal regulations" - the Ministry of Finance requested.
