Nursing home operating without license

Tu Tam S-Merciful Nursing Home in Da Nang branch has no operating license, suddenly announced its closure, and transferred the elderly to Hanoi.

On May 22, relatives of 12 elderly people being cared for at the Tu Tam S-Merciful Nursing Home in Da Nang gathered at the villa at 22 Morrison Street, An Hai Bac Ward, Son Tra District, demanding that the representative of Tu Tam S-Merciful Medical Joint Stock Company (the investor of the nursing home) refund their living expenses.

Tu Tam S-Merciful Company started taking care of the elderly in Da Nang in May 2022. The initial address was at hotel number 150 Vo Nguyen Giap, Phuoc My ward, Son Tra district; in early 2023, it moved to number 22 Morrison street.

Four days ago, relatives of the elderly received notice that the nursing home would be temporarily closed from May 23 until further notice to restructure operations. If customers continue to use the service, the elderly will be transferred to the S-Merciful Hanoi facility (Phu Nghia commune, Chuong My district).

All relatives who are sending the elderly to the nursing home do not agree to the transfer. "We send our parents and relatives here because the nursing home is in Da Nang, close to our family and the sea. Now if we move it to Hanoi, how can we visit them?", said Mr. Nguyen Hong Phuc, the guardian of the 95-year-old man.

Mr. Phuc and the relatives of the 11 elderly people want the company to refund the money they have paid. Some people said they have paid from tens to hundreds of millions of dong, including deposits and advance payments for the coming months, depending on the service package.

Explaining the sudden closure of the center, the nursing home manager, Mr. Tran Hong Linh, said that the company rented a house from a Korean, who sublet the house from another owner. Due to financial difficulties and not being able to pay the 300 million VND rent, the landlord asked the company to return the premises on May 23.

Regarding the request for a refund, Mr. Linh said that according to regulations, customers must terminate the contract, then the company will resolve the matter according to specific procedures and requirements. However, the relatives of the elderly did not agree.

After many working hours, Mr. Linh replied that he did not have the authority to decide on refunding money to relatives. Many people called Ms. Dinh Thi Ngoc Minh, General Director of Tu Tam S-Merciful Medical Joint Stock Company, but she did not cooperate.

Many workers who used to work at the Tu Tam S-Merciful Nursing Home in Da Nang have also come to the company to request their salaries. In a petition sent to the company on May 5, the employees said that 30 workers were owed 1-6 months of salary by the company, totaling about 700 million VND.

Many investors who bought bonds and signed a cooperation contract to invest in a nursing home with Tu Tam S-Merciful Medical Joint Stock Company also called the police for help because they have not been paid interest for more than a year, even though they went to the house of the Company's General Director in Hanoi to collect their debt. Among them, the person who invested the least amount was about 400 million VND, the person who invested the most was about 2 billion VND.

Son Tra District Police have recorded the incident. At the time of inspection, Mr. Tran Hong Linh could not provide a business license or a medical license (licensing medical activities and providing health care for the elderly) as required by the Department of Labor, War Invalids and Social Affairs.

Ms. Nguyen Thi Thu Huong, Deputy Director of the Department of Labor, War Invalids and Social Affairs of Da Nang City, said that the Department has not yet granted a license for this company to operate a nursing home. Because the company shows signs of fraud, the Department has requested the police to investigate.
