The Ministry of Industry and Trade has issued Circular No. 03/2025/TT-BCT stipulating the dossiers, procedures and processes for buying and selling electricity with foreign countries, replacing Circular No. 09/2015/TT-BCT dated May 29, 2015 of the Minister of Industry and Trade guiding the procedures and processes for buying and selling electricity with foreign countries.
This Circular details Clause 8, Article 46 of the Electricity Law No. 61/2024/QH15 dated November 30, 2024 on documents, procedures and formalities for buying and selling electricity with foreign countries; applicable to Vietnam Electricity Group, other organizations and individuals in Vietnam that have a need to buy and sell electricity with foreign countries.
According to the Circular, the purchase and sale of electricity with foreign countries for each electricity import and export project must be approved in principle before implementation.
The plan for purchasing and selling electricity with foreign countries of the electricity import and export project must be consistent with the approved strategy for purchasing and selling electricity with foreign countries in the Vietnam Electricity Development Strategy, the electricity development plan, and the approved plan implementation plan.
In case the electricity purchase and sale plan with foreign countries of the electricity import and export project is consistent with the Electricity Purchase and Sale Strategy with foreign countries and the electricity development plan, but the grid connection plan does not arise in Vietnam's territory or does arise in Vietnam's territory but has not been updated in the plan implementation plan, the Minister of Industry and Trade shall approve the electricity import and export policy for the project and update and supplement the project's grid connection plan into the plan implementation plan.
In case the electricity purchase and sale plan with foreign countries of the electricity import and export project is not consistent with the Electricity Purchase and Sale Strategy with foreign countries, the electricity development plan, the plan to implement the plan, the electricity import and export project must carry out procedures to supplement and adjust the Electricity Purchase and Sale Strategy with foreign countries, the electricity development plan, and the plan to implement the plan before approving the electricity import and export policy for the project.
In case the purchase and sale of electricity with foreign countries uses the power grid of another power grid management unit to carry out the purchase and sale of electricity with foreign countries, the organization or individual must reach a written agreement with this power grid management unit.
Vietnam Electricity Group is the entity that buys and sells electricity to foreign countries through the national power system. Other organizations and individuals in Vietnam that need to buy and sell electricity to foreign countries can buy and sell electricity to foreign countries without going through the national power system.
The Circular clearly states the procedures for approving the policy of buying and selling electricity with foreign countries. Accordingly, Vietnam Electricity Group and organizations and individuals in Vietnam who need to buy and sell electricity with foreign countries are responsible for preparing documents for approval of buying and selling electricity with foreign countries according to regulations and are responsible for the accuracy and honesty of the documents requesting approval of buying and selling electricity with foreign countries.
Vietnam Electricity Group and organizations and individuals in Vietnam who need to buy and sell electricity with foreign countries can choose one of the following methods to submit their application to the Ministry of Industry and Trade directly, online or via postal service.
In case of online application submission: Application for approval of electricity purchase and sale with foreign countries is submitted online on the National Public Service Portal. In case the electronic application is large in size or the documents as prescribed by law cannot be sent via the electronic information network, they can be sent directly or via postal service.
Number of documents in case of direct submission or via postal service: 05 sets.
The procedure for approving the policy of buying and selling electricity with foreign countries is as follows: Within 05 working days from the date of receiving the dossier, the Ministry of Industry and Trade is responsible for responding in writing stating the completeness and validity of the dossier according to regulations.
Within 10 working days from the date of receiving a complete and valid dossier, the Ministry of Industry and Trade shall be responsible for organizing the appraisal and obtaining written opinions on the electricity purchase and sale plan with foreign countries of the electricity import and export project of the following agencies and units:
Relevant ministries, branches and localities for electricity import and export projects connected at voltage levels of 220 kV or higher; Localities and relevant power units for electricity import and export projects connected at voltage levels below 220 kV.
Request Vietnam Electricity Group, other organizations and individuals in Vietnam who have the need to buy and sell electricity with foreign countries to explain their appraisal opinions or organize for the Appraisal Agency to review and evaluate the electricity import and export project at the site if necessary.
Within 15 working days from the date of completion of collecting written opinions from relevant ministries, branches, localities and electricity units on the plan to buy and sell electricity with foreign countries, the Minister of Industry and Trade shall consider and approve the policy for electricity import and export projects.
After the policy of buying and selling electricity with foreign countries is approved, Vietnam Electricity Group, organizations and individuals with the need to buy and sell electricity with foreign countries are responsible for negotiating and signing electricity purchase and sale contracts with electricity purchase and sale partners according to the law and sending documents on buying and selling electricity to foreign countries to the Ministry of Industry and Trade within 07 days before buying and selling electricity with foreign countries.
Documents for selling electricity to foreign countries include: Power purchase and sale contracts signed between the parties; connection agreements of each project to buy and sell electricity to foreign countries.
