By 2025, the National Identity Card will be officially "abolished".
According to Article 2 of Decree 05/1999/ND-CP amended and supplemented by Decree 170/2007/ND-CP, the Identity Card is valid for 15 years from the date of issue (whether it is a 9-digit or 12-digit Identity Card).
From 2036, the National Identity Card will be officially "abolished" and the National Identity Card will not be used after the ban.
However, on November 27, 2023, the National Assembly passed the draft Law on Identification (effective from July 1, 2024).
According to Clause 2, Article 46 of the 2023 Law on Identification No. 26/2023/QH15, Identity Cards that are valid after December 31, 2024 can only be used until December 31, 2024. That is, in 2025, Identity Cards will be officially "eliminated" completely.
Legal documents that use information from the ID card number will remain valid. Citizens will not be required to change or adjust the information about the ID card in the issued documents.
In addition, ID cards that expire from January 15, 2024 to before June 30, 2024 will continue to be valid until June 30, 2024.
Cases where the ID card is not valid
-When a person uses two or more ID cards
This is clearly stated in Circular 04/1999/TT-BCA (C13) guiding Decree 05/1999/ND-CP on Identity Cards (ID).
Specifically, this Circular prohibits a person from using two or more ID cards. In case of loss of ID card and re-issued ID card, if the lost ID card is found, it must be returned to the police agency where the re-issuance procedure was carried out.
-When Vietnamese nationality is revoked/revoked
Point a, Clause 1, Article 10 of Decree 05/1999/ND-CP stipulates that the ID card will be revoked in case a citizen is deprived of or renounces Vietnamese nationality. The ID card is an identification document for Vietnamese citizens, therefore, when renouncing nationality, that person will no longer be able to keep and use the ID card.
-When settling abroad
Even if they have not renounced their Vietnamese nationality, if they settle abroad, citizens are also prohibited from using their ID cards. In this case, their ID cards will also be revoked (according to Point b, Clause 1, Article 10, Decree 05).
-When using someone else's ID card
According to Point a, Clause 2, Article 10 of Decree 144/2021/ND-CP, appropriating and using another person's ID card will be subject to a fine of 1 - 2 million VND.
-Other cases
Article 5 of Decree 05/1999/ND-CP clearly states that the following cases must go through procedures to change ID cards:
+ ID card expired.
+ Damaged ID card cannot be used.
+ Change last name, first name, middle name, date of birth.
+ Change of permanent residence registration outside the province or centrally-run city.
+Change identification features.
