Strengthen inspection and strictly handle violations of construction order.

According to the content of the document of the Ministry of Construction, in recent times, urban management and construction order have gradually become more organized, the sense of responsibility of people and organizations has had positive changes, contributing to improving the efficiency of construction investment, ensuring construction investment is in accordance with planning, plans and compliance with national technical regulations and applicable standards.

However, through the appraisal of construction investment feasibility study reports at the specialized construction agency under the Ministry of Construction, recently there have been cases of a number of projects and works violating regulations on construction investment project management such as: carrying out construction without a construction permit; constructing in violation of the content of the construction permit; not yet preparing, appraising, approving the project, construction design implemented after the basic design has been organized for construction; not yet having the specialized construction agency inspect the acceptance of the completion of the construction work and putting the work into operation...

The Ministry of Construction requests the People's Committees of provinces and centrally-run cities to direct and organize the implementation of the following contents:

Firstly, strengthen the dissemination, propaganda and dissemination of the provisions of the 2014 Construction Law, amended and supplemented by a number of articles of Law No. 62/2020/QH14, Decree No. 15/2021/ND-CP, Decree No. 06/2021/ND-CP, Decree No. 16/2022/ND-CP, Decree No. 35/2023/ND-CP,... on contents related to compliance with construction planning, construction permits, and construction quality management so that local authorities and investors clearly understand and seriously implement legal provisions on management of construction investment projects and construction works.

Second, strengthen inspection and examination work to promptly detect and strictly handle violations of construction order management in the area, especially illegal construction, construction without permits, construction not in accordance with the planning approved by competent authorities and incomplete implementation of regulations on construction investment project management.

Third, for construction works with violations of construction order, there must be measures to handle violations to ensure compliance with legal regulations, avoiding the situation of legalizing violations of individuals and organizations in the field of construction activities.

Fourthly, for projects and works that are noted by the construction professional agency in the notification of the results of the appraisal of the construction investment feasibility study report on the contents that need to be supplemented and completed to be eligible for approval or to implement the next step; it is necessary to overcome the existing problems before carrying out the construction permit issuance procedures.

Accordingly, the competent authority to grant construction permits shall only grant construction permits after the construction investment project has met the approval conditions, the construction design is implemented after the basic design of the project for which a construction permit is requested has been approved in accordance with regulations and fully complies with the requirements for granting construction permits.

In case there is a request to correct or supplement the contents before implementing the request for granting a construction permit, the competent authority granting the construction permit must check the full implementation of these requirements before considering and evaluating to grant a construction permit according to regulations.

Fifth, for any problems or shortcomings that need to be studied, revised, or supplemented to suit the actual situation, it is recommended that localities synthesize and report to the Ministry of Construction for consideration of revision and supplementation according to their authority or request competent authorities to study, revise, or supplement accordingly.
