Is there a penalty for using both an ID card and a Citizen ID card at the same time?

According to Clause 3, Article 11 of Circular 59/2021/TT-BCA, on May 15, 2021, police officers will collect the Identity Card and Citizen Identification Card in use in case citizens complete procedures to switch from Identity Card to Citizen Identification Card or change Citizen Identification Card.

At the same time, Clause 8, Article 5 of Circular 60/2021/TT-BCA, dated May 15, 2021, also stipulates: "Revoke old Identity Cards and Citizen Identification Cards in cases where citizens carry out procedures to change from Identity Cards to Citizen Identification Cards, or change Citizen Identification Cards".

Thus, after issuing the Citizen Identification Card (CCCD), the Identity Card (CMND) will have to be revoked. At that time, the ID card will no longer be valid even though it is intact and still valid. This means that current law only recognizes one type of identification document for each person at each time (CMND or CCCD).

If an individual has been issued a CCCD but still intentionally uses the old ID card when performing transactions and administrative procedures, the user may be administratively fined for failing to comply with the provisions of law on granting, exchanging, and re-issuing Citizen Identification Cards as prescribed in Clause 1, Article 10 of Decree 144/2021, dated December 31, 2021.

Article 10. Violations of regulations on issuance, management and use of Identity Cards, Citizen Identification Cards or Citizen Identification Cards.

1. Warning or fine from 300,000 VND to 500,000 VND for one of the following acts:

a) Failure to present Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate when requested for inspection by a competent authority;

b) Failure to comply with legal regulations on granting, changing, and re-granting Citizen Identification Cards;

c) Failure to return the Identity Card, Citizen Identification Card or Citizen Identification Card to the competent authority when the person is given up, has his/her nationality revoked, or has the decision to grant Vietnamese nationality revoked; failure to return the Identity Card, Citizen Identification Card or Citizen Identification Card to the agency executing the temporary detention order, the agency executing the prison sentence, the agency executing the decision to send to a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.

Thus, people who use both ID card and CCCD card at the same time will be fined from 300,000 to 500,000 VND.

In addition, using both ID card and CCCD in parallel can face many legal risks, especially when using an old, expired ID card to participate in contracts, transactions or carry out administrative procedures.
