Strictly handle violations
On April 8, the Chairman of the People's Committee of Tuyen Quang province signed Decision No. 22/QD-XPHC against Chien Cong Mineral and Industry Joint Stock Company, address: Hamlet 5, Trung Mon Commune (Yen Son) VND 240 million for violations in mineral exploitation. Specifically: In the working minutes dated March 22, 2024 of the Inspectorate (Department of Natural Resources and Environment) with Chien Cong Mineral and Industry Joint Stock Company, it was determined that: Mineral exploitation license No. 11/GP-UBND dated March 28, 2006 of the People's Committee of Tuyen Quang province allowing the company to exploit at Linh Duc coal mine, Linh Phu Commune (Chiem Hoa) has expired from March 29, 2021. However, Chien Cong Mineral and Industry Joint Stock Company did not prepare a mine closure plan for the cases specified in Article 73 of the Law on Minerals.
Tan Ha Company Limited is licensed by the Provincial People's Committee to exploit stone quarries to serve key projects of the province.
Previously, on December 5, 2023, the Inspectorate of the Department of Natural Resources and Environment also issued a decision to sanction Tuyen Quang Construction and Construction Materials Production and Trading Joint Stock Company, headquartered at No. 4, Le Hong Phong Street, Group 14, Minh Xuan Ward (Tuyen Quang City) for violating regulations on the content of periodic reports on mineral exploitation activities with incomplete information according to the form prescribed by the Ministry of Natural Resources and Environment; violating regulations on not reporting or reporting but not being permitted by the competent state management agency as prescribed but still exploiting and using the accompanying minerals...
Also in 2023, the Inspectorate of the Department of Natural Resources and Environment issued a decision to fine Thanh Hai Construction Materials Company Limited, located in Ninh Tan village, Thien Ke commune (Son Duong) for exploiting more than 10% of one of the parameters of the exploitation system. Specifically, the height of the 20-meter floor, while the design document is 5 meters, exceeds 300%; the angle of the 80-degree floor, while the design document is 75 degrees, exceeds 20%.
Strengthening mineral resources management
To strengthen the management and protection of mineral resources, the Department of Natural Resources and Environment has done a good job of receiving and appraising dossiers, in accordance with the procedures and the Law on Minerals. Along with that, the Provincial People's Committee has issued regulations on strengthening State management of mineral activities in the province.
Comrade Pham Manh Duyet, member of the Provincial Party Committee, Director of the Department of Natural Resources and Environment, said that Tuyen Quang has potential for mineral resources, diverse in both metals and non-metals with 200 mines, mining points, 86 mineral points, and mineralization points. However, the reserves and value are not large.
Therefore, the management, protection and rational exploitation of minerals are always given special attention by the industry. The Department will further strengthen the coordination between departments, branches, units and localities in performing mineral management tasks; promote propaganda and dissemination of legal knowledge on mineral exploitation, management and use to organizations and individuals directly involved in these activities; promote the role of supervision, information and reflection of the people to promptly detect and prevent illegal mineral exploitation activities...
Comrade Vu Viet Hung, Chief Inspector of the Department of Natural Resources and Environment, affirmed that the inspection, examination and handling of administrative violations in the field of natural resources and environment have been regularly and seriously implemented by the Department. In the spirit of handling violations, there are no forbidden areas for any enterprises or organizations.
In 2023 and the first 4 months of 2024, the Provincial People's Committee and the Department's Inspectorate inspected and fined 3 enterprises for violations in the field of mineral exploitation, with a total fine of 920 million VND. According to Chief Inspector of the Department of Natural Resources and Environment Vu Viet Hung, in addition to inspecting, checking, detecting and penalizing violations, the sector also conducts post-inspections to monitor and check the process of overcoming the consequences of the violating unit.
Along with implementing the above solutions, the Department of Natural Resources and Environment has completed the draft Project "Zoning off-limits areas, temporarily banning mineral activities" and submitted it to the Provincial People's Committee for approval. It is expected that there will be 1,910 areas where mineral activities are strictly prohibited. This is considered a sustainable solution to protect mineral resources, a valuable non-renewable resource, while also being consistent with the orientation of socio-economic development, harmonizing economic benefits with security and defense, and minimizing environmental impacts caused by mineral exploitation.
