Among them was the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus.

Presenting the Government's previous report, Minister of Justice Nguyen Hai Ninh said that the arrangement and streamlining of the organizational apparatus has a direct and profound impact on the entire system of legal documents.

With such a large number, the requirement to amend each document is an impossible task and risks leading to legal gaps, affecting the normal and continuous operation of agencies as well as the rights and interests of individuals and organizations.

Therefore, the issuance of resolutions by the National Assembly to handle general issues and some specific issues in the process of reorganizing the state apparatus is in accordance with practical requirements.

"Running and queuing at the same time", "The Central Government does not wait for the local authorities"

In the draft resolution, the Government proposes that when implementing the organizational arrangement, the functions, tasks, and powers of the current competent agencies and individuals will continue to be performed by the receiving competent agencies and individuals.

If the name, functions, tasks, powers, position, model, and organizational structure of the agency after the rearrangement change, the competent agency or person shall issue regulations on the functions, tasks, powers, and organizational structure of the agency formed after the rearrangement that are different from the regulations in the documents previously issued by the superior agency.

According to the review report presented by Chairman of the Law Committee Hoang Thanh Tung, this agency assessed that the Government's proposal is necessary to promptly adjust the functions, tasks, powers, and organizational structure of the agencies implementing the arrangement.

Currently, many laws, resolutions of the National Assembly, resolutions of the National Assembly Standing Committee and decrees of the Government still have very specific regulations on the names, tasks, powers, and even the internal organizational structure of a number of agencies from the central to local levels.

The draft regulation will help properly implement the policy of "running and queuing at the same time", increasing the initiative of authorities at all levels, closely following the guiding viewpoint "The Central Government does not wait for the locality" and vice versa.

According to the draft resolution, the Government proposes that when reorganizing the state apparatus and the number of deputies is greater than the maximum number according to current regulations, no later than 5 years from the effective date of the decision on reorganizing the apparatus, the number of deputies of the head of the agency must comply with regulations.

In addition, the supervision, inspection, audit and examination of the agencies formed or received after the arrangement must ensure continuity, no vacancy or overlap in the scope of authority and must not affect the normal operations of these units.

Examining the above content, the Law Committee requests the Government and relevant agencies to report further on whether the draft regulations have covered all cases requiring adjustment of authority, scope of supervision and inspection after the implementation of the arrangement.

The examining agency cited Conclusion No. 121-KL/TW, the Central Executive Committee agreed with the policy of arranging in the direction of not organizing district-level police. In this case, it is necessary to clarify which agency will be responsible for supervising the investigation of criminal cases under the jurisdiction of the district-level People's Court, to avoid problems in the implementation process.
