On the morning of February 21, the Legal Committee of the Provincial People's Council chaired by Comrade Sen Van Bac, Deputy Head of the Legal Committee of the Provincial People's Council, held a meeting to review documents submitted to the 22nd Session (special session). Attending the meeting were Comrade Hau Minh Loi, Member of the Provincial Party Committee, Permanent Vice Chairman of the Provincial People's Council; leaders of the Provincial People's Council Committees; members of the Legal Committee; leaders of the Office of the National Assembly Delegation and the Provincial People's Council, and leaders of relevant departments and branches.

In order to prepare well the documents to be submitted to the upcoming 22nd Session (special) (expected to be held on February 24-25), the Legal Committee of the Provincial People's Council was assigned to review 10 draft Resolutions including: Resolution on reorganizing the Department of Finance of Ha Giang province; Resolution on reorganizing the Department of Construction of Ha Giang province; Resolution on reorganizing the Department of Science and Technology of Ha Giang province; Resolution on reorganizing the Department of Home Affairs of Ha Giang province; Resolution on reorganizing the Department of Health of Ha Giang province; Resolution on reorganizing the Department of Education and Training of Ha Giang province; Resolution on reorganizing the Department of Culture, Sports and Tourism of Ha Giang province; Resolution on reorganizing the Department of Justice of Ha Giang province; Resolution on establishing the Department of Ethnic Minorities and Religions of Ha Giang province.

After examination, the Legal Committee basically agrees with the content of the draft Resolutions submitted by the Provincial People's Committee and attached with Submission No. 17/TTr-UBND dated February 10, 2025. The draft Resolutions submitted by the Provincial People's Committee ensure the conditions for submission to the Provincial People's Council for consideration, discussion and approval.

The report also pointed out the implementation of Resolution No. 18-NQ/TW, dated October 25, 2017 of the 6th Conference of the 12th Party Central Committee on Some issues of continuing to innovate and reorganize the apparatus of the political system to be streamlined, effective and efficient; Conclusion No. 09-KL/BCĐ dated November 24, 2024 of the Central Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW of the Government, with the requirement of setting out the determination to innovate and reorganize the apparatus of the political system in the Provincial Party Committee to be streamlined, strong, efficient, effective and efficient; Professional agencies and public service units under the People's Committees at provincial and district levels, after arranging and organizing the apparatus and restructuring the staff, civil servants and public employees, ensure consistency and unity in state management of sectors and fields from the central to district levels based on the orientation of the Central Steering Committee and the Provincial Steering Committee in accordance with the characteristics and actual conditions in the locality.

On that basis, the Provincial People's Committee develops a plan to establish and reorganize affiliated professional agencies, and submits it to the Provincial People's Council for consideration and decision. The above plan will directly reduce 5 departments under the Provincial People's Committee from 19 to 14; regarding the internal organization of the departments after establishment and reorganization: Departments and equivalents under the department: Reduce 11 departments (from 84 to 73 departments); Department branches and equivalents under the department reduce 4 departments from 13 to 9 departments; public service units under the department reduce 03 units from 108 to 105 units; public service units under the department branches reduce 1 unit.

Therefore, the Provincial People's Committee's submission to the Provincial People's Council for consideration of the decision to establish and reorganize specialized agencies under the Provincial People's Committee on the basis of merging a number of departments and branches with similar functions and tasks ensures the legal basis, necessity and proper authority of the Provincial People's Council as prescribed in Point d, Clause 2, Article 19 of the Law on Organization of Local Government 2015 and Clause 1, Article 21 of Decree No. 158/2018/ND-CP dated November 22, 2018 of the Government.

The dossiers of the draft Resolutions have ensured the order, procedures, and composition according to the provisions of law. The contents of the Basic Projects have fully outlined the contents of necessity, legal basis; name; position, function, task, authority; organizational structure; personnel plan; headquarters, finance, assets; implementation roadmap and other related contents.

The Legal Committee also proposed that the drafting agency should amend and combine them into 01 Resolution because the content and legal basis are the same. It is recommended that immediately after the Resolutions of the Provincial People's Council on the establishment and reorganization of the 10 above-mentioned departments take effect, the Provincial People's Committee, based on the provisions of the law, promptly implement the next steps: Issue a Decision regulating the functions, tasks, powers and organizational structure of the department, and at the same time direct the above-mentioned departments to implement the contents of developing job position projects, managing and using payroll, personnel, etc., carry out asset inventory, settlement of expenses to hand over to the Department of Finance, adjust and arrange records and documents according to regulations; pay attention to fully and promptly implementing the regimes and policies for cadres, civil servants and public employees according to regulations. At the same time, receive comments and make edits to complete the report as a basis for the Provincial People's Council delegates to study and discuss at the Session.
