On March 22, the Ministry of Justice held a Conference on Dissemination, Implementation and Implementation of the 2024 Land Law in both direct and online formats at 63 provinces and cities. Comrade Le Thanh Long, Member of the Party Central Committee, Secretary of the Party Committee, Minister of Justice chaired the Conference. Deputy Ministers of Justice: Nguyen Khanh Ngoc, Dang Hoang Oanh, Tran Tien Dung and Mai Luong Khoi also attended.

Solving many problems and shortcomings in land management and use
The conference aims to disseminate and thoroughly understand the 2024 Land Law for the Judicial sector, ensuring timeliness, substance and effectiveness; raise understanding and awareness of the 2024 Land Law and the responsibilities of the Ministry and the Judicial sector in implementing the Land Law; organize effective implementation in the Ministry and the Judicial sector according to Decision No. 222/QD-TTg dated March 5, 2024 of the Prime Minister promulgating the Plan for implementing the Land Law.
The 2024 Land Law was passed by the 15th National Assembly on January 18, 2024 at the 5th extraordinary session. Compared to the 2013 Land Law, the 2024 Land Law consists of 16 chapters and 260 articles with many important new points, institutionalized in accordance with the spirit of Resolution No. 18-NQ/TW dated June 16, 2022 of the 5th Conference of the 13th Party Central Committee on continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country; contributing to perfecting the socialist-oriented market economic institution; meeting the requirements of synchronously perfecting policies and laws on land management and use.
The 2024 Land Law has also resolved many problems and shortcomings arising from practical land management and use; ensuring harmony of rights and interests of the State, land users and investors; promoting the commercialization of land use rights, developing a transparent and healthy real estate market; thereby, land resources are managed, exploited, and used economically, sustainably and most effectively.
In his opening speech, Deputy Minister of Justice Tran Tien Dung emphasized that the Land Laws in Vietnam over the years, especially the 2024 Land Law, are major laws, of special significance and importance in the country's political, socio-economic, defense, security, and environmental protection life; having a profound impact on all classes of people and the business community. Many new points of the 2024 Land Law are directly related to the functions and tasks of the Ministry and the Justice sector such as the fields of civil enforcement, property auctions, legal aid, etc.
The plan for implementing the 2024 Land Law is issued together with Decision No. 222/QD-TTg dated March 5, 2024 of the Prime Minister; the Government, the Prime Minister and the Ministries need to issue 16 documents detailing the 2024 Land Law, including: 09 Decrees of the Government, 01 Decision of the Prime Minister and 06 Circulars of the Minister.
Deputy Minister of Justice Tran Tien Dung delivered the opening speech at the Conference.
Through review, the Ministry of Justice found that the 2024 Land Law has 18 contents assigned to the Provincial People's Committee to specify in detail and 01 content under the authority of the Provincial People's Council to issue. This requires the proactive and active participation of the Ministry of Justice as well as the Departments of Justice in the process of developing, commenting on, and appraising documents detailing and guiding the implementation of the 2024 Land Law to bring the Law into life. In addition, when the 2024 Land Law comes into effect, some legal problems in some specific cases may arise, requiring the Ministry and the Justice sector to provide opinions.
In order to effectively and qualitatively implement the 2024 Land Law, the Ministry of Justice needs to proactively research, disseminate, and thoroughly understand the Land Law; correctly and fully understand the new points of this Law. Therefore, the Ministry of Justice organized a conference to disseminate and thoroughly understand the Law throughout the sector.
The Deputy Minister requested that the reporters and experts present briefly to save time for exchange and discussion; requested that delegates at the connecting points study the documents, boldly participate in exchange and discussion to clarify the regulations, especially the new points of the Land Law related to the Ministry of Justice, thereby having an orientation to handle related legal issues in the coming time, ensuring quality and substance, contributing to the success of the Conference.
Continue to disseminate and thoroughly understand the 2014 Land Law in various forms. At the Conference, delegates listened to Comrade Le Minh Ngan, Deputy Minister of Natural Resources and Environment, Deputy Head of the Drafting Committee of the Land Law, introduce new points of the 2024 Land Law and some notes for the Judicial sector on: notarization and certification related to the implementation of land users' rights; regulations related to the execution of judgments; development and appraisal of normative documents guiding the implementation of the 2024 Land Law at the central and local levels. On that basis, delegates exchanged and discussed with the expert group of the Ministry of Natural Resources and Environment, the Economic Committee of the National Assembly, the Law Committee of the National Assembly on contents related to the announcement of planning, transfer of rice-growing land, land price list, etc.
Next, representatives of some localities proposed a number of solutions and recommendations for implementing the 2024 Land Law to remove practical difficulties in the locality. Specifically, a representative of the Department of Justice of Bac Giang province suggested that it is necessary to determine a specific roadmap to ensure that the Land Law and its detailed implementing documents are implemented uniformly and synchronously nationwide from the date the Law takes effect. At the same time, it is necessary to regularly and promptly inspect, urge, and guide the removal and resolution of difficulties and obstacles arising during the implementation process to ensure the progress and effectiveness of the implementation of the Law.
The representative of the Department of Justice of Da Nang City added that the 2024 Land Law has 18 contents that the provincial People's Committee must specify in detail and 01 content that is under the authority of the provincial People's Council to promulgate. Therefore, local authorities must also proactively review regulations and legal documents under their authority to amend, supplement, and promulgate new ones to ensure consistency and uniformity. In the work of organizing law enforcement, it is necessary to strengthen propaganda and dissemination of new, notable and impactful points as well as points that need to be clarified; regularly organize training on knowledge of land law and knowledge of state management of land for cadres, civil servants, and public employees performing land management tasks at all levels. In addition, localities also need to focus on implementing digital transformation, applying information technology in land management and use in line with the current digital transformation trend and helping land management and use become more effective and feasible.
Concluding the Conference, Minister Le Thanh Long emphasized that the 2024 Land Law is a very important law, determining socio-economic development and ensuring national defense and security. However, this Law is quite complicated and has a profound impact on many sectors and fields, including the Judiciary. Therefore, the Minister requested that units under the Ministry, the Department of Justice, and professional social organizations directly related to the functions and tasks of the Ministry and the Judiciary continue to disseminate, disseminate, and train cadres, civil servants, public employees, and workers in appropriate forms.
The Minister also requested that units under the Ministry, mainly the Department of Civil and Economic Law; the Department of Justice and the local Civil Judgment Enforcement Department, actively participate, proactively complete and develop detailed regulations and advise competent authorities to handle difficulties and problems.
In addition, units directly involved in the application of the Land Law need to prepare the necessary conditions to be able to apply it as soon as this Law comes into effect. The Minister assigned the Department of Civil and Economic Law to preside over and coordinate with experts and the Judicial Publishing House to research and publish documents for officials and civil servants in the entire Judicial sector to study and use in training courses...

The results of the Conference will contribute to improving the quality of comments and appraisals on documents of the central and local levels detailing and guiding the implementation in accordance with the spirit and requirements of the 2024 Land Law, ensuring unity and synchronization in the legal system; improving the quality of advice of the Ministry of Justice to ensure effective law enforcement, ensure correct understanding and proper and reasonable application of the provisions of the 2024 Land Law, as well as properly handling related issues in the fields of state management of the Ministry of Justice, such as: civil judgment enforcement, notarization activities, auctions, registration of secured transactions, legal aid, etc.; thereby contributing to removing bottlenecks in land resources, thereby promoting socio-economic development of the country and localities. |
