8th Session, 15th National Assembly: Escape skills must not stop at theory

On the morning of November 1, continuing the session program, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Fire Prevention, Fire Fighting and Rescue.

Commenting on the draft Law, delegate Nguyen Minh Tam (Quang Binh) expressed his interest in the content on the responsibilities of agencies, organizations, households and individuals in fire prevention, fire fighting, rescue and salvage activities. The delegate said that Article 7 of the draft Law stipulates that the head of the facility is responsible for establishing and maintaining the operation of the facility fire prevention, fire fighting and rescue team or the specialized fire prevention, fire fighting and rescue team or assigning people to perform fire prevention, fire fighting and rescue tasks within the scope of management according to the provisions of law.

Meanwhile, Article 22, which stipulates fire safety conditions for establishments, also requires the establishment of this force at the establishment or a specialized establishment force according to the provisions of law. At the same time, Clause 4, Article 37 stipulates that the Government stipulates that establishments must establish a Fire Prevention, Fire Fighting and Rescue Team at the establishment, and establishments must establish a specialized Fire Prevention, Fire Fighting and Rescue Team.

There is no consistency among the provisions of the draft Law, and it is not clear in which cases the facility only needs to assign people to perform fire prevention, fire fighting, and rescue tasks without having to establish a team at the team level. "It is necessary to review and adjust these provisions to ensure consistency," said delegate Nguyen Minh Tam.

Giving his opinion on the discussion, delegate Do Van Yen (Ba Ria - Vung Tau) said that currently, many establishments do not meet the standards on fire prevention and fighting but still operate or only discover violations when incidents occur. Therefore, there should be more detailed regulations on the progress of periodic inspections and public and transparent results of fire prevention and fighting inspections at production and business establishments.

Delegates suggested that the Drafting Committee consider adding a provision that production and business establishments must publicly disclose the results of annual fire prevention and fighting inspections on the websites of competent authorities and at the establishments; adding provisions that establishments must periodically inspect every 6 months the operating status of fire prevention and fighting systems.

Also at the meeting, delegate Ha Sy Huan (Bac Kan) said that according to current regulations, the police agency only appraises designs after the basic design, and no longer provides comments on the investment preparation stage (preparing a feasibility study report). Therefore, there will be cases where the project or investment policy must be adjusted when the police agency has an appraisal opinion that does not meet the standards on fire prevention and fighting. This will cause adjustment procedures to arise, affecting the progress of project implementation.

Therefore, the delegate proposed to consider adding the content of the police agency's appraisal for the project preparation step (the step of preparing the Construction Investment Feasibility Study Report) and appraisal for works and projects that only require the preparation of an economic-technical report on construction investment when subject to appraisal on fire prevention and fighting for completeness.

Expressing concern about the issue of additional fire protection for high-rise apartments, according to delegate Vu Hong Luyen (Hung Yen), currently many high-rise apartments were built a long time ago, during the use process, causing damage or repair of technical systems, leading to the work of fire prevention, fire fighting, rescue and relief no longer being guaranteed. Therefore, there should be regulations on the traffic system leading to high-rise apartment buildings to ensure that at least specialized fire prevention, fire fighting, rescue and relief vehicles can access when a fire or explosion occurs to minimize damage to people and property of the people.

At the same time, delegate Vu Hong Luyen emphasized that “escape skills are a basic skill that is especially important for people in any fire”. Therefore, in order to protect themselves and those around them and help reduce casualties as well as coordinate well with rescue forces when fires and explosions occur, the drafting agency should study and supplement more detailed and specific regulations on escape skills.

"This is to ensure that escape skills do not stop at equipping people with theory and knowledge but must become a natural reflex of every citizen when any fire or explosion, big or small, occurs," said a delegate from Hung Yen.

Explaining and accepting at the meeting, Chairman of the National Defense and Security Committee Le Tan Toi said that the drafting agency and the reviewing agency will study, accept thoroughly, and explain specifically to complete the draft Law. In addition, these two agencies have consulted and completed policies in the spirit of creating the most favorable conditions for people and businesses; ensuring safety for people is paramount; and at the same time, removing difficulties that are still stuck in current reality.

Concluding the discussion session, Vice Chairman of the National Assembly Tran Quang Phuong requested the Government to promptly issue legal documents assigned by law to take effect; at the same time, implement them in practice; strengthen propaganda, education, raise awareness and responsibility of the people about the responsibilities of agencies, organizations, individuals, especially the leaders. The Secretary General of the National Assembly urgently has a summary report to send to the National Assembly deputies and transfer to the verification agency to receive, explain and submit to the National Assembly for approval according to the agenda of the session.
